What a Dispute Resolution Letter Is

A Dispute Resolution Letter is a formal written notice that initiates an attempt to resolve a disagreement between parties without immediate litigation. It typically sets out the disputed facts, cites the contractual or legal basis for the claim, states the remedy sought, and identifies any contract clause (mediation, arbitration, escalation) that governs dispute handling. The letter documents the sender’s position, creates a record of the notice, and triggers timelines tied to contract dispute procedures or statutory response periods. It may be sent by mail, email, certified mail, or through an electronic signature platform.

Why a Clear Dispute Resolution Letter Matters

A precise letter preserves legal rights, starts contractual dispute processes, and gives the recipient a clear opportunity to respond or cure the issue before escalation.

Why a Clear Dispute Resolution Letter Matters

Typical Senders and Recipients

The letter is appropriate for organizations and individuals who need a durable written record before mediation, arbitration, or litigation.

  • Contract managers and procurement teams seeking remedial action or contract performance
  • Legal counsel notifying a counterparty of breach and invoking ADR clauses
  • Consumers or small businesses disputing billing, service delivery, or warranty issues

Core Elements to Include in Every Dispute Resolution Letter
