What a Divorce Intake Form Is and When It’s Used

A Divorce Intake Form is a structured questionnaire used by attorneys, mediators, or court assistance programs to collect the factual and legal information needed to open a divorce matter. It centralizes identifying data, marriage and separation dates, children and custody preferences, income and asset summaries, debt information, existing court orders, and any immediate safety concerns. The form streamlines case intake, supports conflict checks, and provides the basis for drafting petitions, temporary orders, settlement proposals, and financial disclosure documents required by many family courts.

Why a Standardized Intake Form Matters for Family Cases

A complete Divorce Intake Form reduces errors, shortens drafting time, and documents client instructions and consent. It creates an audit trail for client communications and ensures critical information (children, assets, restraining orders) is captured early to preserve legal rights and safety.

Why a Standardized Intake Form Matters for Family Cases

Who Typically Completes the Divorce Intake Form

Intake forms are completed by the client with help from intake staff, paralegals, or the attorney to ensure accuracy and completeness.

  • Family law attorneys and partners who need a consistent record to open a file and prepare pleadings
  • Paralegals and intake specialists who verify ID, collect documents, and schedule next steps
  • Clients (self-represented or guided) who provide personal, financial, and custody-related facts

Using a consistent intake form improves client communication, reduces follow-up calls, and produces a defensible record of initial client instructions.

Essential Sections to Include in a Professional Intake Form

A well-designed Divorce Intake Form groups information into predictable sections so staff and counsel can quickly locate facts needed for pleadings and temporary relief requests.

Client Identity

Full legal name, other names used, date of birth, SSN last four, contact information, and government ID details for identity verification and court filings.

Marriage Details

Marriage date, date of separation, place of marriage, grounds for divorce, and whether either party is seeking annulment or legal separation.

Children & Custody

Names, dates of birth, living arrangements, current custody concerns, school districts, and any active CPS or protection orders.

Assets Summary

Real estate, bank accounts, retirement accounts, vehicles, business interests, and approximate values to support temporary and final financial orders.

Debts & Liabilities

Mortgages, credit cards, loans, tax liabilities, and which party is primarily responsible for each obligation.

Prior Orders & Safety

Existing protective orders, criminal charges, restraining orders, prior judgments, and immediate safety or emergency housing needs.

Step-by-Step: From Intake to Filing

Follow a structured sequence to minimize omissions and produce court-ready pleadings quickly.

  • 01
Collect Basic Facts: Gather identity, marriage, separation, and contact information.
  • 02
Assemble Financials: Compile paystubs, bank statements, debts, and asset documents.
  • 03
Assess Immediate Needs: Evaluate emergency relief (temporary custody, protection orders).
  • 04
Prepare Pleadings: Draft petition, financial affidavit, and required local forms for filing.

Typical eSubmission and Case Routing Flow

Digital workflows accelerate intake and preserve an audit trail for each step of the case.

  • Upload Documents: Attach supporting PDFs and images to the intake record.
  • Place Fields: Map signature, date, and checkbox fields for client completion.
  • Request Signature: Send secure signing link or invite to the client.
  • Store & Route: Save completed form to client file and notify counsel or court clerk as needed.

Technical Requirements for Digital Intake and eFiling

Ensure your platform supports secure uploads, PDF and DOCX formats, and industry-standard integrations for records management.

  • File Formats: PDF, DOCX, JPG — retain original PDFs for court submission.
  • Integrations: Works with case management, cloud storage, and calendar systems.
  • Security: TLS in transit and AES-256 at rest protect client data.

Prefer solutions with audit trails, optional two-factor signer authentication, and records export to court eFiling formats.

Security and Compliance Considerations for Intake Data

Encryption: TLS 1.2/1.3 in transit; AES-256 at rest
Audit Trail: Detailed signing logs with timestamps and IP address
HIPAA Support: BAA available when handling protected health information
ESIGN / UETA: Compliant for electronic signature legal validity
SOC 2 / ISO: SOC 2 Type II and ISO 27001 certifications available
Accessibility: WCAG 2.0 Level AA accessibility support

Consequences of Incomplete or Incorrect Intake Data

Late Filing: Delays or missed hearing dates
Incorrect Service Info: Service failures and case dismissal risk
Missing Financials: Unequal support orders or discovery disputes
Unsigned Affidavits: Court rejection of unsworn statements
Undisclosed Orders: Sanctions for nondisclosure
Privacy Breach: Potential HIPAA/CCPA exposure and liability

Common Intake Mistakes to Avoid

  • Omitting alternate or former names causes identification mismatches on financial records and service documents.
  • Providing estimated asset values without attached statements leads to additional discovery and delays in settlement.
  • Failing to note existing protective orders or criminal matters can result in safety risks and additional court procedures.
  • Using PO boxes instead of physical addresses where courts require street addresses may impede service of process.

Timing Items Commonly Tracked on Intake

Track statutory and procedural deadlines so pleadings, responses, and discovery occur on schedule.
