What a Domestic Services Agreement Is and When Parties Use It

A Domestic Services Agreement is a written contract between a household (employer) and an individual or agency providing domestic work such as housekeeping, childcare, elder care, or companion services. The agreement records the scope of work, schedule, compensation, worker classification, confidentiality, and liability allocation. It clarifies access to the home, background-check or insurance requirements, and termination mechanics. While private, a clear signed agreement supports payroll and tax compliance, demonstrates mutual consent to duties, and documents expectations to reduce disputes.

Why a Clear Domestic Services Agreement Matters and Its Legal Standing

A written Domestic Services Agreement reduces disputes, documents tax and payroll responsibilities, and creates evidence of mutual intent. Electronically signed agreements are generally enforceable under the ESIGN Act (15 U.S.C. ch. 96) and UETA where adopted, though some categories remain excluded from e-signature treatment.

Why a Clear Domestic Services Agreement Matters and Its Legal Standing

Who Typically Prepares and Signs These Agreements

Typical users who prepare or sign a Domestic Services Agreement include household employers, domestic workers, placement agencies, and payroll or HR representatives.

  • Household employers: Homeowners or primary residents who hire, set terms, and oversee payment and access.
  • Domestic workers: Individuals providing services who need to acknowledge duties, schedule, compensation, and tax information.
  • Placement agencies: Staffing or nanny agencies that supply workers and manage background checks and invoicing.

Use this template to capture scope, payment schedule, worker classification, termination notice, and any confidentiality or background-check provisions consistently across household engagements.

Who Can Sign and What Authority They Have

Homeowner

Homeowner — The property owner or primary resident who hires the worker, authorizes access to premises, sets the schedule and compensation, and is typically responsible for payroll taxes when the worker is classified as an employee.

Domestic Worker

Domestic Worker — The individual performing services who must confirm identity, agree to the listed duties and pay terms, provide taxpayer information if requested, and sign to acknowledge acceptance of the contract terms.

Core Sections a Professional Domestic Services Agreement Should Include

Specify rate, pay frequency, overtime rules if applicable, payment method, and any reimbursements for supplies or travel.

Schedule & Location

State start date, regular hours, on-call expectations, and the physical location(s) where services will be performed.

Termination

Set notice periods, grounds for immediate termination, final pay rules, and procedures for returning keys or property.

Liability & Insurance

Allocate responsibility for damages, require proof of appropriate insurance where needed, and address confidentiality or privacy concerns.

Begin dates set rights and payroll start.

Termination Notice:

Typical notice is two weeks unless otherwise stated.

Common Mistakes to Avoid When Preparing This Agreement

  • Misclassifying a worker as an independent contractor when duties and control indicate employee status can trigger payroll tax liability and penalties.
  • Failing to obtain a completed W-9 or I-9 when required leads to backup withholding or compliance risk with federal immigration rules.
  • Using vague language about duties, hours, or overtime creates disputes over scope and payment expectations.
  • Neglecting to record signatures, dates, or version control undermines the agreement's evidentiary value in later disputes.

Primary Penalties and Risks for Errors or Noncompliance

1099 Filing Penalties: See IRC §6721; $60–$330 per form for late or incorrect filings
I-9 Violations: See 8 CFR §274a.2; $281–$2,789 per violation
Misclassification Exposure: Back taxes, interest, and payroll penalties
Backup Withholding: 24% withholding if TIN missing or incorrect
Breach of Privacy: Civil liability for improper disclosure of personal data
Contract Ambiguity: Increased litigation risk and enforceability disputes
