What a Doula Services Contract Is and When It’s Used

A Doula Services Contract is a written agreement between a birth or postpartum doula and a client that defines the scope of support, dates and times of services, fees and payment terms, professional responsibilities, and mutual expectations. The contract frames what services the doula will provide (prenatal visits, labor support, postpartum visits), when those services begin and end, how cancellation or rescheduling is handled, and how liability, confidentiality, and dispute resolution are addressed. A clear contract reduces ambiguity, documents consent, and serves as the legal record of the client–provider relationship.

Why a Written Doula Agreement Matters

A written contract protects both parties by documenting service scope, fees, and mutual obligations, reducing disputes and clarifying expectations.

Why a Written Doula Agreement Matters

Who Typically Uses a Doula Services Contract

Use the contract whenever services are offered or booked; executing it before substantive prenatal work begins is best practice.

  • Independent doulas — to define scope, scheduling, and fee arrangements for individual clients.
  • Doula agencies or collectives — to set uniform terms across engagements and manage cancellations or substitutions.
  • Clients and families — to confirm services, payment schedules, and emergency contact procedures.

Core Elements to Include in a Professional Doula Services Contract

A complete contract balances operational details with legal protections. Include terms that set clear expectations for scheduling, fees, consent, confidentiality, and termination.

Parties

Full legal names for client(s) and doula or agency, including business name and contact information for each party.

Scope

Detailed description of services (prenatal visits, continuous labor support, postpartum visits), number and estimated hours per service, and any exclusions.

Fees

Total fee, deposit required, payment schedule, accepted methods, and policies on refunds, sliding scale adjustments, or additional travel charges.

Scheduling

On-call period or estimated coverage window, response time expectations, and protocol for overlapping calls or substitutions.

Cancellation

Terms for client-initiated cancellations, doula unavailability, force majeure, and any nonrefundable deposits.

Legal Terms

Confidentiality, liability limitations, indemnification, governing law, dispute resolution, and signature blocks for both parties.

Step-by-Step: Completing and Executing the Contract

Follow these stages from drafting to retention to keep the process efficient and legally sound.

  • 01
Draft Terms: Define services, fees, and schedules before presenting to the client.
  • 02
Review with Client: Walk through expectations and answer questions to secure informed consent.
  • 03
Sign and Date: Obtain signatures from all parties and record the effective date.
  • 04
Store Record: Save executed copies and any related consent forms securely.

How to Customize and Complete the Contract Online

Configure an online workflow to collect information, signatures, and any required acknowledgements in one streamlined process.

Field Configuration
Client Details Require name, DOB, phone, email; set validation rules for phone and email formats.
Service Selection Use checkboxes or conditional fields to record chosen services and visit counts.
Payment Collection Enable deposit capture or payment links with clear refund rules shown before payment.
Signature Capture Add signature and date fields; include a checkbox for consent to electronic records when applicable.

Where to Send and How to Submit the Executed Contract

Document routing depends on your workflow: direct exchange with clients, agency recordkeeping, or electronic signature platforms.

  • To the Client: Provide a fully signed copy to the client for their records.
  • Provider File: Store an executed copy in the doula’s secure client folder for business records.
  • Agency Repository: If part of an agency, upload to the central contract system and note assigned doula.
  • Third-Party Platforms: Use an eSignature provider to collect signatures, timestamps, and audit trails during execution.

Digital Signing and Distribution Considerations

Retain the signed record, audit trail, and any payment receipts together; ensure access controls and backups are in place.

  • Format Support: PDF and Word DOCX are commonly accepted for contracts.
  • Integrations: Check compatibility with CRM and cloud storage systems for automatic filing.
  • Authentication: Use email verification or stronger methods for signer attribution when required.

Key Timing Considerations and Deadlines

Set and track key dates for deposits, on-call start and end, scheduled visits, and cancellation windows to manage expectations.

Deposit Due Date:

Specify the date when a deposit is required to secure services.

On-Call Start:

Define the expected start of on-call coverage in weeks before estimated due date.

Service Window:

List scheduled prenatal and postpartum visit dates or indicate they will be mutually arranged.

Cancellation Notice:

State required notice period for client cancellations and any associated penalties.

Refund Processing:

Describe timing for refunds or credits after a canceled engagement.

Common Mistakes to Avoid When Preparing the Contract

  • Using vague service descriptions that leave room for differing expectations about hours, travel, or support level.
  • Failing to document deposit terms or refund policies, which often leads to disputes after cancellations or birth plan changes.
  • Neglecting consent language for medical information sharing, photos, or emergency contacts, compromising privacy compliance.
  • Not retaining an executed copy with a verifiable audit trail when an electronic signature was used.

Risks of an Incomplete or Incorrect Contract

Disputes: Unclear scope can lead to unpaid fees or client dissatisfaction.
Liability: Missing limitation of liability exposes the doula to higher legal risk.
Privacy Breach: Absent consent forms can produce HIPAA-related exposure in clinical settings.
Payment Claims: No written fee schedule may hinder collection or dispute defenses.
Regulatory Issues: Incorrect data retention practices can conflict with state or federal rules.
Enforceability: Unsigned or poorly executed agreements may be harder to enforce.

How to Download, Save, and Share the Executed Contract

Save final documents in durable, accessible formats and keep a copy with provenance metadata and the signing audit trail.

PDF Archive

Export the fully executed contract as a PDF/A to preserve layout, signatures, and any embedded audit trail data for long-term storage.

Cloud Backup

Store signed copies in a secure cloud folder with access controls and versioning to protect against accidental deletion.

Client Copy

Provide each party a signed copy by email or secure link and note delivery date in the client file.

Audit Trail

Keep a record of signing events, timestamps, IP addresses, and authentication methods associated with the executed file.
