What the Driving Record Permission Form Is

A Driving Record Permission Form is a written authorization that lets an employer, insurer, or third party request an individual's motor vehicle record (MVR) from a state DMV or third-party vendor. The form documents consent to retrieve driving history, license status, and violations for hiring, risk assessment, or insurance underwriting. Use it to establish lawful access, disclosure scope, and the period covered by the request while creating an auditable trail of consent.

Why this authorization matters

The form protects both requester and signer by documenting consent, limiting the scope of the record request, and supporting compliance with privacy and employment laws. It helps avoid unauthorized access and creates evidence of informed permission for later disputes.

Why this authorization matters

Who commonly completes or requests this form

Employers, insurance underwriters, fleet managers, and background-screening vendors typically request a signed Driving Record Permission Form before obtaining an MVR.

Use the form when you need lawful access to a driving record for hiring, safety compliance, insurance decisions, or regulatory checks.

Core elements a professional form should include

A complete Driving Record Permission Form combines identity details, a clear consent statement, the permitted record types, time frame, data recipients, disclosure limits, and signature authentication. These elements reduce ambiguity and support admissibility.

Identity

Full legal name, date of birth, driver license number, and issuing state for accurate record matching.

Consent Statement

Plain-language authorization that the signer permits release of driving history to named requesters.

Scope

Specify record types (accidents, violations, suspensions), time period, and any exclusions.

Recipient

Name the employer, insurer, or vendor authorized to receive the MVR and any downstream recipients.

Duration

Effective date and expiration or one-time release indicator to limit ongoing queries.

Signature Block

Signed and dated by the subject; include printed name and method of identification used.

Step-by-step: Filling and authorizing the form

Follow these stages to collect valid permission and retrieve a driving record with a clear audit trail.

  • 01
Prepare details: Gather name, DOB, license number, and issuing state.
  • 02
Set scope: Define record types and time period to request.
  • 03
Identify recipient: Name the organization and any third-party processors.
  • 04
Sign and retain: Get signature (wet or e-signature) and store the signed form securely.

Where the signed form is sent and how records are retrieved

A signed authorization follows a predictable path: signer → requester → DMV or MVR vendor → requester. Each transfer should be logged.

  • Signer to Requester: Signer returns the signed form to the employer or vendor who requested the record.
  • Requester to DMV/Vendor: Requester submits the authorization and lookup request to the state DMV or an authorized MVR provider.
  • Record Delivery: DMV or vendor delivers the MVR to the named recipient; delivery method should be secure and auditable.
  • Retention and Update: Requester stores the signed consent and the MVR per retention policy and refreshes consent for future checks as needed.

Configuring an online workflow for this form

Key workflow settings reduce friction and ensure compliance when you collect permissions electronically.

Field Configuration
Identity Fields Require full name, DOB, license number, issuing state
Authentication Use email verification or SMS code for signer attribution
Consent Language Present explicit consent text and require checkbox acceptance
Audit Trail Capture IP, timestamp, and device details

Digital signing and system integrations

Choose a signing platform that supports robust audit trails, configurable authentication, and secure storage.

  • Document Formats: PDF | DOCX supported for upload and signed export
  • Authentication Options: Email, SMS, KBA, or SSO depending on risk level
  • Integrations: CRM and HR systems like Salesforce, NetSuite, and Google Workspace

Ensure your chosen platform provides encryption in transit and at rest, audit logs, and retention controls appropriate for personal data.

Timelines and processing expectations

Understand when to collect consent and how long it typically takes to retrieve an MVR so you can plan hiring or underwriting decisions.

Consent Before Retrieval:

Collect signed permission before requesting the MVR

One-time vs Ongoing:

Specify whether authorization is a single release or valid for a defined term

Vendor Response Time:

MVR vendors commonly return records within 24–72 hours

State DMV Timeframes:

Some state DMVs may take longer — plan 5–10 business days in peak periods

Retention Checkpoints:

Re-authorize before subsequent periodic checks if required

Consequences of incomplete or incorrect authorizations

Access Denied: Incomplete data may prevent retrieval of the correct MVR
Legal Challenge: Undisclosed scopes or expired consent can lead to privacy claims
Regulatory Fines: Violations of state privacy laws or HIPAA-related handling can trigger penalties
Hiring Delays: Missing or invalid consent delays onboarding for driver roles
Insurance Impact: Lack of proper authorization may invalidate underwriting decisions
Reputational Risk: Unauthorized queries can damage trust with employees or applicants

Common preparation mistakes to avoid

  • Failing to match the name exactly to the license resulting in no-match returns
  • Using vague consent language that does not specify the time period or record types
  • Not capturing clear attribution for electronic signatures (missing audit trail)
  • Retaining authorization longer than needed without a legal basis
