What the Earnest Money Instructions Form Is and When it’s Used

The Earnest Money Instructions Form documents how a buyer’s deposit is delivered, held, and disbursed during a real estate transaction. It names the buyer, seller, property, escrow or title company, deposit amount, acceptable payment methods, and any conditions for return or forfeiture. The form also specifies timing for deposit, where funds will be held, disbursement triggers, and signature lines for parties and escrow. Electronic execution is commonly accepted under U.S. e-signature law when intent and consent are recorded, and many organizations use compliant eSignature platforms to capture and preserve a complete audit trail.

Why Clear Earnest Money Instructions Matter

Clear instructions reduce disputes and speed closings by documenting who holds funds, how deposits are made, and the conditions that trigger disbursement or return.

Why Clear Earnest Money Instructions Matter

Who Typically Completes This Form

Several parties commonly prepare or sign earnest money instructions to ensure proper handling and avoid ambiguity in a real estate transaction.
