WHEREAS, the parties intend this form to serve as express written consent and contract authorizing Provider to commence and maintain electric service and related activities pursuant to the terms below.

Each party agrees that any non-public business, technical, or customer information disclosed in connection with the provision of services under this consent shall be kept confidential and used only for performance under this agreement. Confidential information does not include information that is or becomes publicly available through no breach of this provision, is received from a third party without breach of any obligation of confidentiality, or is independently developed without use of confidential material.

Liability and Indemnity

Customer releases Provider from liability for loss or damage to Customer-owned equipment caused by normal operation and routine maintenance, except to the extent caused by Provider's gross negligence or willful misconduct. Customer shall indemnify and hold Provider harmless from any third-party claims arising from Customer's negligence, willful misconduct, or alteration of Provider-installed equipment.

Governing Law; Entire Agreement

Governing Law: This consent and any dispute arising out of it shall be governed by and construed in accordance with the laws of the state of , without regard to conflict of laws principles.
