What the Employee Benefits Form 5500 Is

The Employee Benefits Form 5500 is the annual reporting return used by employee benefit plans covered by ERISA to provide plan, financial, and compliance information to the Department of Labor, IRS, and Pension Benefit Guaranty Corporation. It consolidates plan identification, financial schedules, participant counts, and service-provider disclosures. Sponsors, administrators, and auditors use Form 5500 to demonstrate ongoing compliance with ERISA reporting rules; smaller plans may file simplified versions (e.g., 5500-SF) when eligibility criteria are met. Electronic filing through the DOL EFAST2 system is the standard method of submission.

Why Accurate Form 5500 Filing Matters

Timely, complete Form 5500 filings meet federal ERISA obligations, maintain plan tax status, and reduce audit risk. Accurate reporting protects fiduciaries by documenting plan operations and financial condition for regulators and participants.

Why Accurate Form 5500 Filing Matters

Who Typically Prepares and Uses Form 5500

Employers, plan sponsors, third-party administrators (TPAs), and plan auditors commonly prepare or rely on Form 5500 for compliance and oversight.

  • Plan sponsors and HR teams that own fiduciary responsibility for benefit plans and approve filings.
  • Third-party administrators and recordkeepers who compile financial schedules and plan data for submission.
  • ERISA auditors and external accountants who review financial statements and sign audit schedules when required.

Proper role allocation — who collects data, who reviews, and who files electronically — reduces errors and supports timely submissions.

Step-by-Step: Completing and Preparing Form 5500

Follow these core steps to assemble plan data, obtain required signatures, and file electronically via EFAST2.

  • 01
Gather Plan Documents: Collect SPD, trust statements, and plan amendment records.
  • 02
Compile Financials: Include audited statements or schedules as required.
  • 03
Confirm Participant Data: Validate counts and eligibility snapshots.
  • 04
Sign and File: Obtain authorized signature then submit via EFAST2.

Where to File and How Submission Works

Form 5500 is submitted electronically to the Department of Labor using the EFAST2 system; filers may use authorized transmission agents or commercial software to transmit filings.

  • EFAST2 Transmission: File directly or through a TPA using the DOL's EFAST2 portal.
  • Attachments and Schedules: Attach required schedules and audit reports when thresholds apply.
  • Filer Confirmation: Keep the transmission acknowledgment and validation records.
  • Corrected Filings: Submit amended returns using the same EFAST2 transmission process.

Filing generally occurs after plan year close and before the DOL deadline.

Extension Options:

Audited financials must be attached when plan size exceeds thresholds.

Correction Periods:

Submit amended filings promptly when errors are discovered.

Common Mistakes to Avoid When Preparing Form 5500

  • Failing to include required service-provider fee disclosures (Schedule C) can trigger inquiries and potential penalties.
  • Delaying signatures or using ambiguous signature authority can invalidate the filing and complicate remedial corrections.

Penalties and Compliance Risks for Incorrect or Late Filings

ERISA Penalties: Monetary penalties for late or missing filings under DOL enforcement.
IRS Follow-Up: Incorrect EINs or missing tax items can prompt IRS notices.
Audit Triggers: Incomplete reports increase likelihood of DOL or PBGC audits.
