Plan Identification

Recitals

WHEREAS, Plan Sponsor maintains the employee benefits program identified above for the benefit of eligible employees and their dependents; and

WHEREAS, this document serves both as the Summary Plan Description (SPD) required to communicate material plan provisions to participants and as the Election Form through which an eligible employee may make benefit elections and authorize payroll deductions.

Summary Plan Description — Key Provisions

Purpose: The Plan provides a coordinated set of employee welfare and retirement benefits as authorized by the Plan Sponsor and administered in accordance with the official Plan documents and benefit contracts. Benefits available under the Plan may include medical, dental, vision, life insurance, disability coverage, flexible spending accounts, and retirement savings opportunities.

Eligibility and Participation: Employees who satisfy the eligibility rules established by the Plan Sponsor may enroll. Generally, an employee becomes eligible after completing the required service period and meeting any classification requirements. An eligible employee must enroll within the specified election period or during a permitted special enrollment event to obtain coverage.

Claims and Appeals: Claims for benefits under insured programs are governed by the terms of the applicable insurance or benefit contracts. Claims for plan-administered benefits must be submitted in writing to the Plan Administrator. The Plan provides a reasonable claim and appeal procedure; final benefit determinations are made in accordance with the Plan documents.

Termination of Participation: Coverage ceases upon termination of employment, end of eligibility, or as otherwise provided by the applicable benefit provision. Certain benefits may continue for qualified beneficiaries under continuation provisions; the independent terms of those continuation rights control.

Amendment and Plan Termination: The Plan Sponsor reserves the right to amend, modify, suspend or terminate any or all Plan benefits at any time. No amendment, modification or termination will operate retroactively to the extent prohibited by applicable law or by the terms of an insurance contract.

What the Employee Benefits Plan SPD and Election Form Is

The Employee Benefits Plan SPD and Election Form combines a Summary Plan Description (SPD) with an enrollment or election form used by employees to choose benefits under an employer-sponsored plan. The SPD explains plan terms, eligibility, benefits, claims procedures, and participant rights under ERISA-style plans, while the election form records an employee's specific choices for coverage, beneficiaries, and contribution levels. Together these documents create the operative record of an employee's enrollment elections and provide the disclosures required for lawful plan administration and participant notice.

Why an Accurate SPD and Election Form Matters

A clear, complete SPD plus a properly completed election form reduces administrative disputes, supports regulatory compliance, and documents employee choices in a reproducible record.

Why an Accurate SPD and Election Form Matters

Who Prepares and Completes These Documents

Employers, HR teams, plan administrators, benefits brokers, and employees each play distinct roles in preparing, distributing, and completing the SPD and election form.

  • HR and plan administrators: configure plan options, distribute SPDs, and collect elections
  • Benefits brokers and advisors: review plan language and advise on compliant election choices
  • Employees and covered individuals: review SPD terms, make elections, and sign the election form

Each party must keep a copy of the signed election and the SPD; employers retain records to meet ERISA, tax, and audit requirements.

Step-by-Step: Completing the SPD and Election Form

Follow these sequential steps to prepare, distribute, and capture valid elections for each participant.

  • 01
Prepare SPD: Assemble plan descriptions, eligibility rules, and claims procedures for distribution.
  • 02
Configure Election Form: Add fields for name, plan selections, beneficiary, effective date, and signature.
  • 03
Distribute to Employees: Provide SPD and form during enrollment or eligibility windows with required disclosures.
  • 04
Record and Retain: Store signed elections and SPD copies in a secure, auditable system.

Key Components to Include in a Professional SPD and Election Form

A compliant SPD and clear election form should include essential plan details, participant instructions, and legally required notices to reduce ambiguity and legal exposure.

Plan Summary

Concise description of covered benefits, eligibility rules, and plan year so participants understand core entitlements and limitations.

Eligibility Rules

Clear criteria for who may enroll, waiting periods, and qualifying events that permit mid-year elections.

Contribution Details

Employee and employer contribution levels, payroll deduction timing, and pre/post-tax designations.

Claims and Appeals

Stepwise claims filing instructions and internal appeal timelines to ensure participants can exercise rights.

COBRA and Continuation

Notice language describing continuation coverage options and deadlines under federal COBRA requirements.

Signature Block

Designated fields for participant signature, date, and any witness or notary requirements where applicable.

Information Fields Employers Must Collect

Employee Identity: Full legal name
Contact Details: Address, phone
Tax Identifier: SSN or employee ID
Coverage Selection: Plan code or tier
Beneficiary Data: Name and relationship
Signature: Signed and dated entry

Penalties and Risks of Incorrect or Missing Information

Tax Reporting Errors: Backup withholding or reporting penalties
HIPAA Violations: Potential civil penalties for PHI mishandling
ERISA Noncompliance: Fiduciary exposure and corrective actions
COBRA Failures: Penalties for failing to offer continuation coverage
Enrollment Disputes: Claims denials or coverage gaps
Recordkeeping Shortfalls: Audit findings and fines

Common Preparation Pitfalls to Avoid

  • Using ambiguous plan labels that do not match insurer plan codes, which leads to misapplied coverage and delayed claims processing.
  • Collecting incomplete beneficiary information (missing DOB or SSN) that prevents timely payout or benefits administration.
  • Failing to provide required consumer disclosures for electronic delivery, which can invalidate consent to receive documents electronically.
  • Retaining only paper or only electronic copies without secure backups, increasing risk of data loss or audit noncompliance.

Where to File or Send Completed SPDs and Election Forms

Completed election forms and SPDs should be routed to the correct administrative endpoints to ensure valid enrollment and record retention.

  • HR Records: Primary repository for signed elections and participant files.
  • Benefits Vendor: Send election data to insurers or third-party administrators.
  • Payroll: Transmit contribution/deferral data for payroll processing.
  • Participant Copy: Provide employee a signed copy for their records.

Platform Capabilities and File Format Considerations

Use a platform that supports secure PDF and DOCX uploads, preserves audit trails, and enables role-based access for administrators.

  • File Formats: PDF, DOCX supported
  • Integrations: HRIS and payroll connectors
  • Authentication: Email, SMS, or advanced KBA

Select a provider that can produce tamper-evident signed PDFs, store documents encrypted at rest, and integrate with systems like HRIS, payroll, and benefits administration platforms.

Timing and Critical Deadlines to Track

Monitor these timeframes to ensure the SPD and election form are distributed, accepted, and processed within required windows.

SPD Distribution for New Participants:

Provide SPD to new eligible employees promptly; typical best practice is within 90 days of eligibility.

Open Enrollment Window:

Employer-defined period during which employees make annual elections; length varies by employer.

Change-in-Status Windows:

Election changes allowed only for qualifying life events within the plan's specified timeframe.

COBRA Election Period:

Federal COBRA gives a 60-day window to elect continuation coverage after a qualifying event.

Record Retention Start:

Retention obligations begin on date of creation or termination as specified by policy and law.
