What the Employment-Based PERM EB3 Form is and where it fits

The Employment-Based PERM EB3 Form refers to the Department of Labor (DOL) permanent labor certification process used to sponsor foreign nationals for third-preference (EB-3) immigrant visas. Employers complete the ETA-9089 labor certification and follow DOL recruitment and documentation rules to establish there are no qualified U.S. workers for the position. Successful PERM certification is typically followed by an I-140 immigrant petition filed with U.S. Citizenship and Immigration Services (USCIS) and, later, adjustment of status or consular processing for the beneficiary. The process is employer-driven and requires accurate recruitment records, wage attestations, and complete supporting evidence for adjudication.

Why accurate PERM EB-3 paperwork matters

A correctly prepared Employment-Based PERM EB3 Form establishes legal basis for permanent employment-based immigration, reduces audit exposure, and supports downstream USCIS filings. Accurate documentation helps avoid denials, significant delays, and employer liability under DOL rules.

Why accurate PERM EB-3 paperwork matters

Who prepares and relies on this form

Employers, HR teams, immigration counsel, and foreign-national employees each play defined roles in PERM preparation and filing.

  • U.S. Employers and HR teams — manage recruitment, complete employer attestations, and maintain required records.
  • Immigration attorneys — advise on compliance, prepare ETA-9089 and supporting evidence, and respond to DOL audits.
  • Beneficiaries (foreign nationals) — provide identity documents, employment history, and evidence of qualifications.

Clear role allocation reduces errors and creates an evidentiary trail for both DOL and later USCIS review.

Core components of a professional Employment-Based PERM EB3 Form package

A complete PERM EB-3 submission bundles the ETA-9089 with recruitment logs, wage documentation, job description, and employer attestations to meet DOL requirements.

ETA-9089

The official DOL electronic labor certification form capturing employer details, job offer, SOC/O*NET code, and wage information; precise entries determine case routing.

Recruitment Report

Comprehensive record of recruitment steps, dates, applicant responses, and lawful job posting copies required to demonstrate good-faith recruitment.

Prevailing Wage

Certified prevailing wage determination or evidence of wage offer tied to the SOC code; wage must meet or exceed the DOL-determined rate.

Job Description

Detailed duties, minimum requirements, location, and work schedule; inconsistent descriptions between recruitment and ETA-9089 trigger audits.

Employer Attestations

Employer statements regarding recruitment, foreign worker displacement, and ability to pay the offered wage throughout the process.

Supporting Documents

Copies of advertisements, placement confirmations, applicant interview notes, and any state licensing evidence that supports the position.

Stepwise process to complete and file a PERM EB-3 application

Use a consistent sequence—prevailing wage, recruitment, ETA-9089 completion, then electronic submission—to create a defensible record and simplify audit responses.

  • 01
Obtain Prevailing Wage: Request DOL wage determination before recruitment begins.
  • 02
Conduct Recruitment: Complete required ads and document applicant responses per DOL guidance.
  • 03
Prepare ETA-9089: Populate employer, job, wage, and recruitment fields with verified data.
  • 04
Submit Electronically: File ETA-9089 via DOL's online system and retain the submission confirmation.

High-level submission flow for PERM EB-3 filings

Understand the sequential handoffs from HR to counsel to DOL to maintain a complete audit trail and confirm each milestone before proceeding.

  • Prepare Documents: Gather recruitment proofs, wage determination, and employer attestations.
  • Review and Sign: Authorized representative and counsel review, then sign electronically if allowed.
  • File with DOL: Submit ETA-9089 electronically through the DOL portal.
  • Track & Respond: Monitor case status and respond to any audit requests promptly.

Recommended digital workflow settings for PERM document preparation

Configure platform controls to enforce required fields, capture signer identity, and preserve recruitment evidence for audit readiness.

Technical capabilities to support PERM EB-3 eFiling and recordkeeping

Choose a platform that supports secure PDFs, audit trails, and integration with your HR and document systems.

  • File formats: PDF and DOCX support for uploads and signed exports.
  • Integrations: Connectors for HRIS, Google Workspace, Box, NetSuite and common CRMs.
  • Authentication: Email, SMS code, and SSO options for signer verification.

Key timing rules and typical processing expectations

PERM has defined recruitment and filing windows; missing windows or incomplete recruitment records are common causes for audit or denial.

Recruitment Window:

Recruitment steps must generally occur within 180 days before filing.

Job Order Minimums:

Advertise and post according to DOL-required minimum durations for each medium used.

Filing Confirmation:

Retain the DOL electronic filing confirmation as proof of submission.

Audit Response:

DOL issues audit requests with strict deadlines; respond promptly to avoid denial.

USCIS Follow-on Filings:

After certification, expect separate USCIS I-140 timing and fees.

Sequential milestones from wage to certification

Track these milestones as a linear sequence to keep the PERM EB-3 case on schedule and defensible in an audit.

01

Prevailing Wage Determination

Obtain from the State Wage Survey before recruitment begins.

02

Recruitment Campaign

Complete required ads and maintain applicant records per DOL rules.

03

ETA-9089 Submission

File electronically and retain confirmation and case ID.

04

Audit/Decision

If audited, supply documented evidence; DOL may certify or deny.

Common pitfalls to avoid when preparing PERM EB-3 materials

  • Incomplete recruitment records or missing copies of advertisements that prevent DOL from verifying good-faith recruitment.
  • Wage offers that do not match the prevailing wage determination or inconsistent wage reporting across documents.
  • Employer and beneficiary name mismatches between ETA-9089, payroll records, and supporting IDs or credentials.
  • Using vague job requirements or changing minimums after recruitment, which can trigger an audit or denial.

Consequences of incorrect or noncompliant PERM EB-3 filings

Denial: DOL can deny the labor certification, halting the immigrant visa path.
Audit Findings: Adverse audit results can require re-recruitment or lead to denial.
Employer Liability: Potential wage or recordkeeping sanctions for willful violations.
Debarment Risk: Severe or repeated violations can lead to debarment from hiring foreign nationals.
Delay to Beneficiary: Errors create downstream delays for I-140 and adjustment of status.
Increased Costs: Additional legal fees, re-filing, and extended recruitment add expense.

Security and compliance features to protect PERM materials

Encryption: TLS 1.2/1.3 in transit; AES-256 at rest
Audit Trail: Comprehensive logs with timestamps and signer attribution
Certifications: SOC 2 Type II and ISO 27001 available
HIPAA Support: HIPAA-compliant options with a signed BAA
eSignature Law: ESIGN and UETA compliance for enforceability
21 CFR: 21 CFR Part 11 compliant controls available
