What an Employment Retrenchment Agreement Is and When it Applies

An Employment Retrenchment Agreement is a written contract that documents the terms of an employee separation resulting from workforce reduction, restructuring, or position elimination. It typically addresses severance pay, final compensation, benefits continuation, return of company property, confidentiality, release of claims, and any post-employment obligations such as noncompete or nondisclosure provisions. Employers use this agreement to clarify mutual obligations, reduce litigation risk, and ensure an orderly transition. Employees receive clear terms for compensation, benefits, and any assistance; both parties sign to confirm acceptance of the separation package.
