What the ERISA Plan Renewal Form Is

An ERISA Plan Renewal Form documents changes and confirms ongoing terms for an employer-sponsored retirement or welfare plan governed by the Employee Retirement Income Security Act (ERISA). It records the renewal effective date, plan number, sponsor and administrator details, contribution rates or funding elections, service provider updates, and any amendments to plan benefits or eligibility. Employers, plan sponsors, and third-party administrators use the form to capture authorized approvals and to create an auditable record needed for internal compliance, recordkeeping, and downstream reporting to recordkeepers and third-party vendors.

Why a Proper Renewal Form Matters

A complete ERISA Plan Renewal Form establishes the effective terms of coverage, creates an auditable record of sponsor decisions, and helps demonstrate compliance with ERISA requirements and administrative obligations. Proper execution supports plan governance, avoids disputes about amendments, and reduces downstream operational errors.

Why a Proper Renewal Form Matters

Who typically prepares and signs this form

The form is completed and reviewed by internal and external parties responsible for plan governance and administration.

  • Plan Sponsor / Employer: Responsible for approving benefit or funding changes and providing corporate authorization and EIN verification.
  • Plan Administrator / HR Lead: Prepares the renewal, verifies participant impact, and coordinates with recordkeepers and TPAs.
  • Third-Party Administrator (TPA): Reviews technical compliance, updates plan documents, and implements elections in plan systems.

Final signatures typically come from an authorized company officer or plan administrator and any required fiduciary signers.

Core elements to include in a professional renewal form

A well-structured ERISA Plan Renewal Form groups administrative data, renewal terms, plan amendments, funding elections, service-provider assignments, and signer attestations so reviewers can validate compliance and implementation quickly.

Plan Identifiers

Include plan name, plan number, employer EIN, and plan year to uniquely link the renewal to plan records and filings.

Renewal Term

Specify the renewal effective date, expiration (if any), and whether changes are prospective or retroactive, to define the operative period.

Contributions / Funding

State employer/employee contribution rates, matching formulas, and any new funding elections so payroll and recordkeepers can update calculations.

Service Providers

List TPAs, recordkeepers, advisors, and any plan counsel changes with contact details and effective dates for vendor onboarding.

Benefit Changes

Describe material plan amendments, eligibility changes, or benefit design updates with references to associated plan document sections.

Authorization

Provide authorized signer blocks, dates, titles, and attestations confirming fiduciary authority and that proper processes were followed.

Essential fields required on the form

Plan Name: Full legal plan name
Plan Number: Assigned EIN suffix
Employer EIN: Nine-digit EIN
Effective Date: MM/DD/YYYY format

  • Recordkeeper / TPA: Provide for payroll and benefit administration updates
  • Plan Counsel: Retain for legal review and potential filings

Distribution and eSubmission options

Choose secure channels that preserve an audit trail: secure email, vendor portals, or compliant eSignature platforms with retention controls.

  • eSignature: Capture timestamps and signer attribution
  • Remote Notary: Use RON where notarization is required
  • Vendor Integrations: Send directly to recordkeepers or TPAs

Ensure any platform used supports ESIGN/UETA compliance, audit trails, and access controls; verify HIPAA or other BAAs where health data is involved and confirm integration capabilities with payroll or HRIS systems.

Key timing and deadline considerations

Plan renewals should respect effective dates and allow sufficient time for administrative updates, participant notice, and plan reporting.

Renewal Effective Date:

Form must be executed before the stated effective date to avoid retroactive disputes

Participant Notice Window:

Provide participants adequate notice per the plan's summary plan description and internal policies

TPA Update Deadline:

Notify TPAs and recordkeepers at least 30 days before implementation, when feasible

Recordkeeper Processing:

Allow 7–30 days for payroll and system changes depending on vendor SLAs

Form 5500 Impact:

Annual Form 5500 deadlines are tied to plan year; filings are due seven months after year-end

Common mistakes to avoid

  • Using an incorrect employer EIN or plan number causes IRS and recordkeeper mismatches and may trigger backup withholding or reporting delays.
  • Failing to obtain authorized signatures or corporate resolutions can lead to disputes about whether amendments were validly adopted.
  • Not notifying TPAs or recordkeepers in time produces payroll errors, misapplied contributions, and potential participant complaints.
  • Leaving ambiguous funding language or conditional clauses makes administration and nondiscrimination testing more difficult to apply correctly.

Penalties and compliance risks

Plan Disqualification: Loss of tax-qualified status
IRS Penalties: Monetary fines and corrective costs
Fiduciary Liability: Breach claims and recovery obligations
Participant Claims: Benefit disputes and litigation
Administrative Fines: Vendor or regulator penalties
Recordkeeping Failures: Audit findings and remediation costs
