IN THE CHANCERY COURT OF THE _____ JUDICIAL DISTRICTOF _____ COUNTY, MISSISSIPPI IN THE MATTER OF THE ESTATE OF _________________, DECEASED NO. ____________ ORDER FOR PROBATE OF WILL AS MUNIMENT OF TITLE ONLY This matter came on to be heard this day on the Petition of _________________, an adult resident citizen of the State of Mississippi, filed in this cause, and the Court having heard and considered this matter, finds as follows. I. That on or about the ___ day of _____, 20___, _________________, an adult resident citizen of the _____ Judicial District of _____ County, Mississippi, departed this life, leavi ng a Last Will and Testament which was dated _____ ___, 20___, and which was duly witnessed by _________________, _________________, and _________________, all of whom are adults. A true and correct copy of said Last Will and Testament is attached as Exhibi t "A" to said Petition, the original of which was produced at the hearing hereof and filed in this cause. II. That at the time of her death, the said _________________, deceased, had a fixed place of residence in the _____ Judicial District of _____ County, Mississippi, and that this Court has full jurisdiction of the estate of the deceased. III. That said Petitioner, _________________, was the husband of _________________, and _________________ survived _________________. That _________________ left all of her property under her Last Will and Testament to _________________. IV. That at the time of the execution of said Will by _________________, she was above the age of twenty-one (21) years, of sound and disposing mind and memory and in all respects capable of making said Last Will and Testament, and that same was properl y executed and witnessed as required by law, and that said Will is the authentic Last Will and Testament of _________________; and that the Affidavit of _________________ and _________________, two of the witnesses to said Will, has been duly filed in this cause, affirming that said Will was properly executed. V. That all known debts of the decedent and her estate have been paid, and no Federa l or State estate taxes were due from said decedent, _________________, and the value of decedent's personal estate at the time of her death, exclusive of any interest in real estate, did not exceed the sum of _________________ Dollars ($________), exclusive of exempt property and property which would pass outside of her probate estate. IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that said Last Will and Testament of _________________, deceased, is hereby received, approved and admitted to probate in this Court, as a muniment of title only, under the provisions of Section 91-5-35 of the Mississippi Code of 1972 , as amended, the provisions of which are fully applicable to allow said will to be admitted to probate as muniment of title only to the real esta te owned by the decedent at the time of her death.
