What an EV Charging Agreement Covers

An EV Charging Agreement is a written contract that documents the installation, ownership, payment, operation, and ongoing maintenance responsibilities for electric vehicle charging equipment at a specific location. It defines the parties (owner, installer, operator), scope of work, pricing and billing arrangements, permitting and inspection obligations, warranty and service terms, and any site access or utility coordination required to provide and operate the charging station.

Why a Clear EV Charging Agreement Matters

A clear agreement reduces disputes, clarifies who pays for permits and upgrades, sets maintenance expectations, and protects parties from unforeseen liability. It also documents compliance with permitting, electrical code, and utility interconnection requirements.

Why a Clear EV Charging Agreement Matters

Core Sections to Include in Every Agreement

Use these six elements as the foundation of a professional EV Charging Agreement so expectations, legal obligations, and service levels are clear for all parties involved.

Parties

Identify each party by legal name, entity type, contact details, and the authorized signer who can bind the organization.

Scope of Work

Describe site work, electrical upgrades, charger model and quantity, mounting, conduit routing, and acceptance criteria for completed work.

Permits and Inspections

Assign responsibility for securing permits, scheduling inspections, and paying permit fees; note timeline dependencies for installation.

Payment Terms

Specify total price, deposit, milestone payments, invoicing schedule, late fees, and who is responsible for utility upgrades or demand charges.

Warranties and Maintenance

State manufacturer warranty, installer workmanship warranty, routine maintenance obligations, response times, and parts replacement policies.

Liability and Indemnity

Allocate risk for property damage, personal injury, and third-party claims; include insurance minimums and indemnity scope.

Step-by-Step: Completing the Agreement

Follow these sequential steps to prepare, review, and finalize the EV Charging Agreement for signature and recordkeeping.

  • 01
Prepare Document: Populate parties, site details, scope, pricing, and schedule.
  • 02
Confirm Permits: Verify who applies and estimated permit timelines.
  • 03
Review Warranties: Ensure manufacturer and installer warranty terms are included.
  • 04
Sign and Archive: Obtain signatures, date the agreement, and store copies securely.

How to Configure an Online Signing Workflow

Set up a clear digital workflow so signers receive the document in the correct order and authentication level matches the agreement's sensitivity.

Field Configuration
Authentication Level Email link or SMS code; use higher-proof methods for commercial installs.
Signing Order Sequential or parallel signing depending on dependencies.
Conditional Fields Show payment or permit fields only when applicable.
Audit Trail Enable full event logging (IP, timestamp, actions).

Digital Signing Process at a Glance

Typical online signing follows a short sequence from upload to completed audit trail for straightforward tracking and storage.

  • Upload Document: Add the agreement PDF or DOCX to the signing platform.
  • Place Fields: Add signature, date, and checkbox fields where needed.
  • Assign Signers: Enter signer emails and specify signing order.
  • Send for Signature: Dispatch email link or share a secure signing URL.

Technical Options for eSigning and Distribution

Verify the platform can produce a tamper-evident signed file, audit trail, and retain records according to legal and company retention policies.

Warranty Void: Manufacturer or installer warranties may be unenforceable
Tax Impact: Loss of eligible incentives or deduction issues
Project Delays: Missed timelines increase cost and client dissatisfaction
Liability Exposure: Claims for damage or personal injury

Common Mistakes to Avoid When Preparing the Agreement

  • Unclear scope or exclusions leading to change-order disputes and unexpected costs for one party.
  • Mismatched party names or signer authority that can invalidate enforcement or delay payments.
  • Failing to allocate responsibility for required electrical upgrades or utility interconnection fees.
  • Omitting inspection and acceptance criteria, which creates disagreement about when work is complete.

Who Typically Prepares and Signs These Agreements

Assign clear signing authority — corporate signers should list job titles and confirm authority to bind the organization.

  • Property owners and facility managers who control site access and budget for installations and upgrades.
  • Licensed electrical contractors and installers who warrant workmanship and coordinate inspections and code compliance.
  • Charging station operators or networks that manage billing, software, and ongoing maintenance responsibilities.

Representative Signer Profiles

Facility Manager

A facility manager typically represents a property owner and coordinates permitting, access, and budgeting. They must confirm authority to approve site changes and ongoing operational agreements in writing before signing.

Licensed Electrician

A licensed electrical contractor signs on behalf of the installer, attesting to compliance with electrical code and inspection requirements. Their signature binds the installer to workmanship warranties and safety obligations.

Real-World Examples of Agreement Use

Practical examples illustrate common contract structures and outcomes across property and installation scenarios.

Office Building Installation

A landlord contracted for 10 chargers for tenant use, with landlord financing and tenants reimbursing energy costs

  • Installer was responsible for permits and inspections
  • After final inspection the landlord assumed operational responsibility and a maintenance vendor was retained for three years.

Public Charging Deployment

A municipality procured stations with grant funding and required vendor background checks

  • Vendor provided ongoing telemetry and payment processing
  • The agreement required prevailing wage compliance and extended retention for audit purposes.
