Scope of Work

Participant agrees to comply with all Organizer safety requirements, directions of event marshals, and applicable rules for the Fire Truck Pull. Participant acknowledges that operation of the pull involves close proximity to heavy vehicles, rigging, and physical exertion.

Payment Terms

Unpaid amounts shall accrue interest at on outstanding balances. Participant is responsible for any collection costs, including reasonable attorney fees, incurred by Organizer to collect delinquent amounts.

Term and Termination

This Agreement commences on Start Date: and continues through End Date: , unless earlier terminated as provided herein. Either party may terminate for convenience upon written notice delivered not less than days prior to the effective date of termination. Termination does not relieve Participant of payment obligations accrued prior to the effective date of termination.

Confidentiality

Each party acknowledges that during the term of this Agreement it may receive Confidential Information of the other party. "Confidential Information" means non-public information disclosed in connection with this Agreement, including but not limited to participant lists, financial terms, and proprietary operational procedures. Receiving party shall not use or disclose Confidential Information except as required to perform obligations under this Agreement, and shall use at least the same degree of care to protect Confidential Information as it uses to protect its own confidential information, but in no event less than reasonable care. Confidentiality obligations survive termination for a period of three (3) years.

Assumption of Risk and Release

Participant acknowledges and expressly agrees that participation in the Fire Truck Pull carries inherent risks, including but not limited to bodily injury, property damage, permanent disability, and death. Participant freely and voluntarily accepts and assumes all such risks and responsibilities.

Release: In consideration of being permitted to participate, Participant hereby releases, waives, discharges, and covenants not to sue Organizer, its officers, directors, employees, volunteers, agents, sponsors, and affiliates (collectively, Released Parties) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by Participant, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.

Indemnification and Insurance

Participant shall indemnify, defend and hold harmless the Released Parties from and against any and all claims, liabilities, losses, damages, costs and expenses (including reasonable attorneys' fees) arising out of Participant's participation, breach of this Agreement, or willful misconduct. Organizer shall maintain event liability insurance as required by local permit authorities; Participant acknowledges that such insurance may not cover Participant's individual injuries and is encouraged to maintain personal health insurance.

Medical Treatment and Disclosure

Participant authorizes Organizer to obtain emergency medical treatment at Participant's expense if Organizer, in its sole discretion, determines that such treatment is necessary. Participant agrees to notify Organizer in writing of any physical limitations that would preclude safe participation.

Minor Participant

Participant is a minor under the age of 18. If checked, the undersigned parent or legal guardian certifies that they have the legal authority to consent on behalf of the minor and accept and execute this Agreement and Waiver on the minor's behalf.

Photo and Media Release

Participant grants Organizer the right to photograph, record, and use Participant's name, image, voice, and likeness in connection with event promotion, marketing, and media without compensation. Participant may opt out by notifying Organizer in writing prior to the event.

Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of without regard to its conflict of law principles. The parties agree that exclusive jurisdiction and venue for any action arising out of this Agreement shall be the state or federal courts located in the county where Organizer's principal place of business is located.

Entire Agreement; Severability

This Agreement and any exhibits or attachments constitute the entire agreement between the parties relating to the subject matter herein and supersede all prior and contemporaneous agreements, representations, and understandings, whether oral or written. If any provision of this Agreement is held invalid or unenforceable, the remainder of the Agreement will remain in full force and effect to the maximum extent permitted by law.
