Organizer may suspend or terminate access immediately if Participant fails to comply with safety rules, if Participant endangers others, or if weather or conditions pose a safety hazard. Participant may terminate with written notice subject to the refund provisions in Payment Terms.

CONFIDENTIALITY

Each party agrees that any non-public operational, financial or personally identifying information obtained pursuant to this Agreement will be kept confidential and used only for the performance of obligations under this Agreement, except as required by law or with express written consent of the disclosing party.

ASSUMPTION OF RISK, RELEASE AND INDEMNIFICATION

Participant acknowledges that aquatic activities carry inherent risks including, without limitation, drowning, collision, slip and fall, and exposure to chemicals. Participant voluntarily assumes all such risks and agrees that Organizer and Facility Owner, and their officers, employees, contractors and agents ("Released Parties"), shall not be liable for injury, death or property damage except to the extent arising from gross negligence or intentional misconduct of a Released Party.

Participant releases, waives and discharges the Released Parties from any claims, demands, losses, liabilities or costs (including attorneys' fees) arising out of or related to Participant's use of the pool and facilities. Participant agrees to indemnify and hold harmless the Released Parties from claims brought by third parties arising out of Participant's actions or omissions.

MEDICAL AUTHORIZATION

In the event of injury or medical emergency, Participant authorizes Organizer and Facility personnel to secure emergency medical care deemed necessary and agrees to be financially responsible for such care.

PHOTO/VIDEO RELEASE

Participant grants permission for Organizer to capture and use photographs, audio, and video that may include Participant for promotional, educational, or documentation purposes. Participant waives any right to compensation for such use.

RULES AND COMPLIANCE

Participant agrees to obey all posted rules, lifeguard instructions, and Organizer directions. Alcohol, glass containers, and horseplay are strictly prohibited. Failure to comply may result in removal without refund.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of , without regard to conflict of law principles.

ENTIRE AGREEMENT

SEVERABILITY
