Event Race Registration and Participation Agreement

THIS AGREEMENT is entered into between the Event Organizer and the Participant as of the dates set forth below.

WHEREAS, Participant desires to register and participate in the Event under the terms and conditions set forth herein and to pay the applicable entry fee.

Either party may terminate this Agreement for material breach by providing written notice to the other party. Notice Period (days):

Confidentiality

Each party agrees that it will not disclose or use any Confidential Information of the other party except as necessary to perform its obligations under this Agreement. "Confidential Information" excludes information that is or becomes generally available to the public through no wrongful act of the receiving party, or is independently developed without use of the disclosing party's Confidential Information.

Waiver, Assumption of Risk and Indemnity

Participant affirms that Participant is in adequate physical condition to participate in the Event, consents to any medical treatment deemed necessary, and assumes all risks associated with participation. Participant releases, waives, and agrees to indemnify and hold harmless Event Organizer, its affiliates, sponsors, volunteers and officials from any claims, liabilities, losses or damages arising from Participant's participation, except to the extent caused by Organizer's willful misconduct.

Governing Law; Entire Agreement

This Agreement shall be governed by and construed in accordance with the laws of the state specified by Event Organizer. Any action arising under this Agreement shall be brought exclusively in the courts of that state. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements, understandings, negotiations and discussions, whether oral or written.

Miscellaneous Provisions

If any provision of this Agreement is held unenforceable, the remaining provisions shall continue in full force and effect. No waiver of any breach shall be deemed a waiver of any subsequent breach.

Participant certifies that the information provided in this registration is true and complete to the best of Participant's knowledge and understands that falsification may result in disqualification from the Event without refund.
