Describe all work the Applicant will perform related to tent installation, anchoring, utilities, site preparation, and cleanup. Include schedule for setup and removal and identify responsible contractors.

INSURANCE, INDEMNITY, AND SAFETY

Applicant shall furnish a certificate of insurance naming Issuing Authority as additional insured, evidencing commercial general liability coverage with limits no less than $1,000,000 per occurrence and statutory workers' compensation coverage. Applicant agrees to indemnify, defend, and hold harmless Issuing Authority, its officers, agents, and employees from and against all claims, liabilities, losses, damages, costs and expenses, including reasonable attorney fees, arising from or related to the installation, use, maintenance, or removal of the tent(s).

Applicant certifies that tents and accessories will be installed and maintained in accordance with applicable building and fire safety standards. Inspections may be required prior to occupancy; tents shall not be used for public access until approved.

To the extent either party discloses proprietary business information in connection with this application, the receiving party shall keep such information confidential and use it only for purposes of reviewing or administering the permit, provided that this obligation shall not apply to information that is public record or required to be disclosed by law.

GOVERNING LAW

This Agreement and the issuance of any permit under it shall be governed by the laws of the state where the Property is located. Venue for any legal action arising from this Agreement shall lie exclusively in the competent state or federal courts located in the same jurisdiction.

ENTIRE AGREEMENT

This Application, together with any approved site plan, permits, insurance certificates, and written conditions issued by the Issuing Authority, constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations and understandings. Modifications must be in writing and signed by both parties.
