EVICTION RENTAL AGREEMENT

This Eviction Rental Agreement (the "Agreement") is entered into on Date: by and between Landlord Name: with mailing address: ("Landlord"), and Tenant Name: with mailing address: ("Tenant"), concerning the rental premises located at: (the "Premises").

RECITALS

WHEREAS, Tenant is currently obligated to pay rent for the Premises and is alleged to be in arrears as of the date of this Agreement; and

WHEREAS, Landlord has initiated or threatened eviction or unlawful detainer proceedings to recover possession of the Premises due to nonpayment, breach or other grounds; and

WHEREAS, the parties desire to set forth their respective rights, obligations and any forbearance or payment arrangements to avoid or resolve litigation and to provide certainty regarding possession, payments, and the disposition of security deposits and damages.

NOW, THEREFORE, in consideration of the mutual covenants contained herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Landlord and Tenant agree as follows:

1. DEFINITIONS

In this Agreement, the following terms shall have the meanings set forth: "Arrearage" means the total monetary amount that Tenant owes to Landlord for unpaid rent, fees, late charges and other charges incurred through the date specified in Section 3; "Cure" means payment in full of sums required to avoid termination or further legal action as set forth in this Agreement.

2. ACKNOWLEDGMENT OF ARREARAGE

Tenant acknowledges that as of the Arrearage owed to Landlord is $. This amount is a complete and correct accounting of unpaid rent, fees and applicable late charges through the referenced date unless otherwise stated in writing signed by both parties.

3. PAYMENT PLAN; FORBEARANCE

Landlord agrees to forbear from pursuing further eviction or possession actions for the period set forth below provided Tenant timely complies with all payment obligations and other covenants of this Agreement. The parties agree to the following payment plan:

4. VACATE DATE; SURRENDER

If Tenant fails to make any payment when due under this Agreement or otherwise breaches any material covenant and such failure is not cured within the applicable cure period set forth below, Tenant shall vacate and surrender the Premises by unless otherwise agreed in writing.

Surrender shall include removal of Tenant's personal property, delivery of keys, and return of possession to Landlord in broom-clean condition, ordinary wear and tear excepted. Tenant shall be liable for all holdover damages, rent, costs of removal and storage of personal property, and other losses resulting from a failure to timely surrender possession.

5. DEFAULT; REMEDIES

A default under this Agreement shall occur if Tenant fails to make any required payment within days after written notice of nonpayment, or otherwise materially breaches this Agreement and fails to cure within the time specified in this Agreement. Upon default, Landlord may (a) terminate any forbearance and pursue all available legal remedies including eviction, damages and collection; (b) declare the full Arrearage immediately due and payable; and (c) recover reasonable attorneys' fees and costs incurred in enforcing this Agreement to the extent permitted by law.

6. SECURITY DEPOSIT AND APPLICATION OF PAYMENTS

The parties agree that Landlord may retain and apply the security deposit, if any, toward outstanding arrearages, damages, and unpaid rent as permitted by law. Tenant authorizes Landlord to apply the security deposit in the amount of $ toward the Arrearage. Any remainder of the security deposit after permitted deductions shall be handled in accordance with applicable law and delivered to Tenant at final forwarding address.

7. ATTORNEYS' FEES AND COSTS

Should either party employ counsel to enforce any provision of this Agreement or to collect any monetary sum due hereunder, the prevailing party shall be entitled to recover reasonable attorneys' fees, court costs and other expenses incurred, to the extent allowed by applicable law.

8. ENTRY AND INSPECTION

Landlord shall have the right to enter the Premises for purposes of inspection, showing, repair, or securing possession consistent with applicable law and any emergency situations. Except in emergencies, Landlord shall provide Tenant with reasonable notice prior to entry as required by statute.

9. MUTUAL RELEASE AND FORBEARANCE

In consideration of Tenant's compliance with the Payment Plan and other covenants herein, Landlord agrees to forbear from filing or pursuing eviction or other claims related to the Arrearage that are expressly covered by this Agreement during the forbearance period. Upon full performance of Tenant's obligations under this Agreement, Landlord shall release Tenant from any further liability for the Arrearage to the extent expressly stated in a written release signed by Landlord. This Agreement does not release claims for damages, rent or breaches arising after the effective date of this Agreement except as expressly set forth herein.

10. NOTICES

All notices required or permitted under this Agreement shall be in writing and delivered personally or sent by certified mail, return receipt requested, or by hand-delivery to the addresses set forth below or to such other address as either party may designate in writing.

11. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the state in which the Premises are located, without regard to conflicts of law principles. Venue for any action arising under this Agreement shall lie in the courts of competent jurisdiction in the county where the Premises are located.

12. ENTIRE AGREEMENT; SEVERABILITY

This Agreement contains the entire understanding between the parties and supersedes all prior agreements, representations and understandings, whether written or oral, relating to the subject matter herein. If any provision of this Agreement is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

13. AMENDMENT; WAIVER

No amendment or modification of this Agreement shall be effective unless in writing and signed by both parties. No waiver of any breach shall constitute a waiver of any other breach or of the right to enforce any term of this Agreement.

14. COUNTERPARTS

This Agreement may be executed in counterparts, each of which shall be deemed an original, and all of which together shall constitute one and the same instrument. Facsimile or electronic signatures shall be binding and admissible to the same extent as original signatures.
