Insurance Provision: It Is Further Ordered and Adjudged, that except as otherwise provided for in this Agreement that all rights of the parties in and to the proceeds of any policy or contract of life insurance, endowment, or annuit y upon the life of the other in which either was named or designated as beneficiary, or to which either became entitled by assignment or change of beneficiary during the marriage or in anticipation thereof, are hereby cut off and at an end unless the insur ed shall reaffirm after the date of the Judgment of Divorce that the other party shall be a beneficiary of any policy or contract of life insurance, endowment, or annuity upon the life of the insured now in existence or the insured shall affirmatively desi gnate the other party as beneficiary of any new policy or contract of life insurance, endowment, or annuity upon the life of the insured. 10. Attorney Fees: It Is Further Ordered and Adjudged, that the parties that each shall be responsible for payment o f his or her own attorney fees and costs incurred with proceeding with the instant action for divorce. 11. Modification, Waiver or Breach: It Is Further Ordered and Adjudged, that no modification or waiver of any of the terms hereof shall be valid unless in writing and signed by both parties. No waiver of any breach hereof or default hereunder shall be deemed a waiver of any subsequent breach or default of the same or similar nature. 12. Release of Claims: It Is Further Ordered and Adjudged, that except as otherwise herein expressly provided, the parties shall and do hereby mutua lly release and forever discharge each other from any and all actions, suits, debts, claims, demands and obligations whatsoever both in law and in equity which either of them ever had, now has or may hereafter have against the other, upon or by reason of a ny matter, cause or thing, up to the date of the entry of this Judgment of Divorce. 13. Estate Planning Provision: It Is Further the agreement of the parties that they will arrange their estate planning to provide for the following: Further, each party shall provide verification that the estate planning has been accomplished. 14. Recordation of Judgment: It Is Further Ordered and Adjudged, that each party shall forthwith execute, acknowledge, and deliver to each other, as and when required, any and al l deeds, assignments, insurance applications and/or other instruments of release, assurance transfer or conveyance required in order to effectuate the terms and provisions hereof; provided that in the event either of said parties shall fall, refuse or negl ect to execute, acknowledge and deliver any instrument required in order to implement the terms and provisions of this Judgment of Divorce, then in that event, said Judgment shall be self -executing and shall stand in the place and stead of any of the inst ruments required hereunder; further, a certified copy of this Judgment of Divorce may be recorded in the offices of any Register of Deeds, Secretary of State, or other public office thereto to have the same force and effect as if such instrument has, in fa ct, been executed. 15. Enforcement: It Is Further Ordered and Adjudged, that the parties shall perform their respective executory obligations, as herein specified, with the utmost good faith. In the event that a party hereto wrongfully falls to fulfill s aid obligations, thereby necessitating the institution of enforcement proceedings, the party in wrongful default of this Judgment shall pay the court costs and reasonable attorney fees incurred by the non -defaulting party in such enforcement proceedings. 16. Disclosure by Parties: That each of the parties hereto represents that he or she has made a full and complete disclosure to the other party of all assets acquired during the course of the marriage and that this Judgment contains a complete itemization of the aforesaid assets and the distribution thereof 17. Effective date of Judgment: It Is Further Ordered and Adjudged, that this Judgment of Divorce shall become effective immediately upon being signed and filed in the Office of the Clerk of the Court. 18. Jurisdiction: It Is Further Ordered and Adjudged, that this Court specifically reserves and retains jurisdiction over this cause and the parties for the purpose of assuring compliance with the executory provisions of this Judgement of Divorce and it reserves the right to make such other and further orders as shall be necessary to implement this Judgment including the use of the contempt powers of the Court.
