What the Exclusive Auction Authority Form Is

The Exclusive Auction Authority Form is a written agreement that gives a single auctioneer or broker the exclusive right to market and sell specified property by public auction. It identifies the parties, describes the property, sets the auction terms (reserve or absolute), addresses deposits and escrow, and allocates commissions and fees. The form defines the contract term and the auctioneer’s authority to accept bids, enter into sale contracts, and remit proceeds. Electronic execution is generally enforceable under the ESIGN Act (15 U.S.C. ch. 96) and state UETA laws when the e-signature meets intent, consent, attribution, and retention requirements.

Why an Exclusive Auction Authority Form Matters

A clear exclusive authority reduces competing marketing claims, sets enforceable auction rules, assigns responsibilities for deposits and closing, and establishes remedies for breach while enabling secure electronic execution under ESIGN and UETA.
