What an Exit Interview Consent Form Is and When It’s Used

An Exit Interview Consent Form documents a departing employee’s agreement to participate in an exit interview and to the collection, use, and retention of information gathered during that meeting. Typical elements include the employee’s identifying information, scope of consent (topics covered, recording permission if any), confidentiality statements, and signature with date. Employers use this form to confirm voluntary participation, track acknowledgement of company property return, and create an auditable record for HR and legal review. The form may be executed on paper or electronically under applicable U.S. e-signature law.

Why a Clear Consent Form Matters and Its Legal Foundation

A concise Exit Interview Consent Form clarifies expectations, documents consent to collect personal or proprietary information, and reduces risk of later disputes. Electronic execution is legally enforceable under the ESIGN Act (15 U.S.C. ch. 96) and state UETA statutes where adopted; New York follows ESRA.

Best practices for accurate, compliant completion

Adopt consistent templates, limit sensitive data collection, and use secure e-signature platforms to reduce risk.

Use plain-language consent text
Write consent statements in clear, non-technical language so employees understand what they agree to; avoid legalese that reduces clarity and increases the risk of contested consent.
Limit sensitive data collection
Collect only information necessary for offboarding; do not capture health or medical data unless it is essential and covered by a HIPAA BAA and appropriate safeguards.
Preserve an auditable trail
Ensure the signing platform records timestamps, IP addresses, and signer attribution to support enforceability under ESIGN and UETA.
Coordinate with payroll and legal
Align consent timing with final payroll processing and legal holds to avoid disputes and ensure required records are available when needed.
