FAMILY PARENTS AGREEMENT

This Family Parents Agreement (the Agreement) is made effective as of by and between Parent A Name: and Parent B Name: .

The parties are the natural or legal parents of the following child(ren): and wish to set forth their mutual responsibilities and obligations concerning care, decision-making and shared expenses.

RECITALS

WHEREAS, the parties were together/incorporated as parents for the purpose of raising the child(ren) described above and desire to set forth a written agreement to reduce misunderstandings and disputes; and

WHEREAS, the parties intend that this Agreement govern parenting time, decision-making authority, allocation of day-to-day and extraordinary expenses, and other responsibilities that arise during the term of this Agreement; and

WHEREAS, the parties acknowledge that the best interests of the child(ren) are paramount and agree to cooperate in good faith to provide for the child(ren)'s health, education and welfare.

SCOPE OF WORK

The parties agree that the Scope of Work above includes, without limitation, daily custodial responsibilities, agreed parenting time exchange locations, holiday allocation, transportation responsibilities, and the allocation of decision-making authority for routine and major decisions concerning the child(ren).

PAYMENT TERMS

Parent A agrees to pay to Parent B the sum of per for the support and ordinary expenses of the child(ren). Payments are due on the day of each payment period.

Extraordinary or uninsured expenses (including but not limited to medical, dental, orthodontic, educational, extracurricular and therapeutic costs exceeding ordinary amounts) shall be shared as follows: .

Late payments shall incur a late fee of on the overdue amount after a grace period of days. Continued failure to remit required payments shall be grounds for enforcement as provided in this Agreement.

TERM AND TERMINATION

This Agreement shall commence on and shall continue in effect until , unless earlier terminated or modified pursuant to the terms herein.

Either party may terminate this Agreement by providing written notice to the other party at least days prior to the intended termination date. Termination does not relieve either party of obligations that have accrued prior to termination, including any outstanding payments or reimbursement obligations.

CONFIDENTIALITY

Each party agrees that the terms of this Agreement and confidential information concerning the child(ren), the other party's personal information, financial records and any agreements related to the child(ren) shall remain confidential and shall not be disclosed to third parties except: (a) as required by law; (b) as necessary to enforce the terms of this Agreement; or (c) with the prior written consent of the other party. Notification to professionals providing services to the child(ren) for the purposes of care and treatment is permitted where necessary.

DISPUTE RESOLUTION

The parties agree to attempt in good faith to resolve disputes arising under this Agreement by informal negotiation. If negotiation fails, the parties agree to submit the dispute to mediation prior to initiating any court proceeding, unless emergency relief is required. The parties may select binding arbitration only if both parties execute a written election to arbitrate.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of , without regard to conflict of laws principles.
