Family Portrait Photography Contract

This Family Portrait Photography Contract (the "Agreement") is made and entered into as of , by and between Photographer Name: , with business address , and Client Name: , residing at .

Recitals

WHEREAS, Photographer is a professional photographer offering portrait photography services and possesses the technical skill, equipment, and staff necessary to perform family portrait sessions under the terms set forth herein;

WHEREAS, Client desires to engage Photographer to perform a family portrait session on the date and at the location specified below and to receive photographic images and related deliverables as set forth in this Agreement;

WHEREAS, the parties intend that this Agreement shall govern the relationship between them with respect to the photography services described below.

NOW, THEREFORE, in consideration of the mutual promises set forth below, the parties agree as follows:

1. Services

1.1 Services. Photographer agrees to provide a family portrait photography session (the "Session") and to deliver the photographic images and related services described in this Agreement. Session date: ; Session time: ; Session location: .

2. Fees and Payment

2.1 Fee. Client agrees to pay Photographer a total fee of $ (the "Fee") for the Session and specified deliverables.

2.2 Payment Schedule. Deposit is due to secure Photographer's booking. The remaining balance is due no later than . Photographer reserves the right to withhold delivery of final images until full payment is received.

3. Cancellation and Rescheduling

3.1 Cancellation by Client. The deposit is non-refundable except as expressly provided herein. If Client cancels less than days before the Session, Client remains responsible for the full Fee, less any nonrecoverable expenses agreed in writing.

3.2 Rescheduling. Client may request one reschedule without additional charge if notice is given at least days before the Session. Additional reschedules may incur a fee and are subject to Photographer's availability.

4. Deliverables and Turnaround

4.1 Deliverables. Photographer will deliver the following: number of edited digital images: ; delivery format: Digital files   Prints   Album (additional fee applies).

4.2 Turnaround. Photographer will deliver proofs or final images within calendar days after the Session, subject to timely receipt of all payments and Client selections.

5. Copyright and License

5.1 Copyright. Photographer retains all copyright and moral rights in and to the images produced. Client is granted a limited, non-exclusive, non-transferable license to use the delivered images for personal, non-commercial use only, including prints, social media display, and family distribution.

5.2 Commercial Use. Any commercial use, resale, or licensing of the images by Client requires Photographer's prior written consent and payment of a separate licensing fee. If Client requires an extended license for commercial use, check here: and proposed fee $ .

6. Model Release and Publicity

6.1 Model Release. Client hereby irrevocably grants Photographer and Photographer's agents the right to use, publish, and reproduce the images for Photographer's portfolio, advertising, editorial, and website purposes in any media now known or hereafter developed, unless Client checks the box below declining permission. I decline permission for Photographer's use.

6.2 If declined, Photographer agrees not to use images for promotional purposes and Client acknowledges that such limitation does not affect Photographer's ownership of the copyrights.

7. Client Obligations

8. Limitation of Liability; Indemnification

8.1 Limitation of Liability. Photographer's liability for any claim, whether in contract, tort (including negligence), or otherwise arising out of or relating to this Agreement shall not exceed the total amount of fees actually paid by Client to Photographer under this Agreement. In no event shall Photographer be liable for incidental, consequential, or punitive damages.

8.2 Indemnification. Client shall indemnify and hold harmless Photographer from and against any and all claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from Client's breach of this Agreement, Client's misuse of the images, or third-party claims concerning Client-provided props or locations.

9. Force Majeure

Neither party shall be liable for delay or failure to perform caused by circumstances beyond its reasonable control, including but not limited to acts of God, governmental action, public health emergencies, weather conditions preventing safe performance, or other force majeure events. In such event, the parties shall make good faith efforts to reschedule the Session.

10. Notices

All notices required or permitted under this Agreement shall be in writing and delivered to the addresses below by hand, certified mail (return receipt requested), or other nationally recognized courier service and shall be deemed given upon receipt.

11. Amendments; Waiver; Counterparts

This Agreement may be amended only by a written instrument signed by both parties. No waiver of any provision shall be effective unless in writing and signed by the waiving party. This Agreement may be executed in counterparts, each of which shall be deemed an original and together shall constitute one instrument.

12. Governing Law; Entire Agreement; Severability

This Agreement shall be governed by and construed in accordance with the laws of the state of , without regard to its conflict of law principles. This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations and understandings. If any provision is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
