What a Fax Letter of Authorization Is and When to Use It

A Fax Letter of Authorization is a brief written instruction that grants a person or organization permission to send, receive, or act on behalf of another party using fax transmission for a defined purpose. It typically identifies the authorizing party, the authorized recipient, the scope of authority, effective dates, and a signature. Organizations use it to permit third parties to transmit documents, receive sensitive information, or submit paperwork where a faxed copy is accepted as proof of authorization.

Why a Clear Fax Letter of Authorization Matters

A properly executed Fax Letter of Authorization reduces processing delays, clarifies responsibilities, and creates an auditable record of consent. In regulated contexts it helps demonstrate authorization for information release and supports compliance with ESIGN and state electronic transaction laws.

Why a Clear Fax Letter of Authorization Matters

Who Typically Prepares and Signs This Letter

Organizations and individuals create Fax Letters of Authorization when they need a documented, transferable permission to send or receive records by fax.

  • Healthcare providers and offices that authorize third parties to receive patient faxed records for continuity of care.
  • Real estate agents and property managers authorizing brokers or attorneys to transmit closing documents by fax.
  • Finance and billing departments permitting third-party billers or insurers to send or collect invoices by fax.

Clear role definitions in the letter reduce disputes and speed downstream processing for both sender and recipient.

Step-by-Step: Prepare and Send a Fax Letter of Authorization

Follow these sequential actions to create, validate, and distribute a compliant Fax Letter of Authorization.

  • 01
Draft: Write the parties, scope, fax number, and effective dates.
  • 02
Verify Identity: Confirm signer identity by phone or ID where required.
  • 03
Sign: Obtain wet or compliant electronic signature and date.
  • 04
Transmit: Fax to the authorized number and keep delivery confirmation.

How a Fax LOA Moves Through Your Workflow

A simple authorization usually travels from requester to authorizing signer to recipient, with verification and retention steps built in.

  • Request: Requester prepares LOA and sends to authorizer.
  • Approval: Authorizer reviews and signs the letter.
  • Transmission: Signed LOA is faxed to recipient; send confirmation to requester.
  • Recordkeeping: Store signed copy per retention policy.

Typical Digital Workflow Settings for eSubmission

Configure these fields in your document workflow to capture authorization reliably and to preserve an audit trail.

Field Configuration
Signature Method Wet signature or ESIGN-compliant e-signature
Authentication Email verification or SMS code
Document Format PDF/A preferred for long-term retention
Retention Set retention per regulatory needs and access rules

Technical and Platform Requirements for eSubmission

Ensure your platform supports secure transmission, audit trails, and the file formats you use before replacing paper faxes.

  • File types: PDF, DOCX, or TIFF
  • Security: TLS in transit; AES-256 at rest
  • Integrations: EHR, CRM, cloud storage

Core Elements to Include in a Professional Fax LOA

A well-crafted authorization makes intent and scope explicit, reduces disputes, and ensures recipients accept the faxed instruction.

Authorizer

Full legal name and job title of the person granting permission, establishing clear attribution for the authorization.

Authorized Recipient

Name and company of the person or entity allowed to send or receive faxes on the authorizer’s behalf.

Fax Number

Exact fax number and any dialing prefix to ensure correct routing of documents and to prevent accidental disclosure.

Scope of Authority

Precise description of actions permitted (send, receive, accept documents) and any limitations or excluded document types.

Effective Period

Start and end dates or an explicit event-based termination condition to limit ongoing authority.

Signature and Date

Handwritten or ESIGN-compliant signature with printed name and title to evidence intent and consent.

Security and Compliance Details to Note

Encryption: TLS 1.2/1.3 in transit; AES-256 at rest
Audit Trail: Capture timestamps, IP, and actions
BAA Requirement: Use BAA for HIPAA-protected data
ESIGN / UETA: Meets ESIGN and UETA standards
21 CFR Part 11: Available for regulated records
Access Controls: Two-factor authentication options

Risks and Legal Consequences of Faulty Authorization

Unauthorized Disclosure: Possible HIPAA or privacy violations
Contract Disputes: Service denials or disputes over acceptance
Regulatory Fines: Penalties for noncompliance with sector rules
Operational Delay: Processing holds and remediation tasks
Invalid Evidence: Rejected by counterparty without clear authorization
Reputational Harm: Loss of trust after misrouted sensitive faxes

Common Preparation Errors to Avoid

  • Leaving the effective or expiry date blank can create indefinite authority that parties later dispute.
  • Using ambiguous scope language such as 'all records' without defining types or date ranges leads to overbroad access.
  • Failing to verify the recipient fax number is a frequent cause of accidental disclosure and rejected transmissions.
  • Relying on unsigned or initial-only authorizations causes many recipients to refuse faxed documents as unauthorized.

Timelines and Typical Processing Expectations

Plan for verification steps and retention periods; processing times vary by recipient and regulatory review requirements.

Provide Upon Request:

Supply LOA when a payer or recipient asks to authorize fax receipt.

Effective Date:

Authorization is valid from the stated start date.

Revocation Notice:

Allow reasonable lead time (often 24–72 hours) for revocation to be processed.

Processing Time:

Recipients often process LOAs within 1–5 business days.

Retention Requirement:

Keep signed LOAs per retention rules applicable to the record type.
