Seller hereby certifies and represents that the information below is true and complete to Seller's knowledge and that Seller understands the property will be offered for financing insured by the Federal Housing Administration. Seller Certifications

Seller certifies under penalty of perjury that Seller has disclosed all material facts known to Seller regarding the condition of the property and has not intentionally concealed any defects or conditions that would affect the safety, habitability or value of the property. Seller further certifies that there are no undisclosed, unpermitted additions or alterations that would conflict with FHA occupancy and safety standards unless disclosed above.

Seller further agrees to: (a) permit the Buyer and Lender access for appraisal and inspections; (b) complete required repairs as set forth in the FHA appraisal or, if Seller elects, accept an escrow holdback approved by the Lender; and (c) indemnify and hold harmless Buyer and Lender from losses arising from Seller's failure to disclose material defects or to complete required repairs as agreed.

Default, Remedies and Governing Law

If Seller's certifications prove materially false, or Seller fails to perform required repairs or to comply with FHA repair requirements, Buyer and Lender shall have the right to (i) terminate the purchase agreement according to its terms, (ii) withhold funds at closing to correct defects, or (iii) seek damages and specific performance as permitted by law. This agreement shall be governed by the laws of the state in which the property is located.

This FHA Certification Form, together with the purchase agreement and any addenda expressly incorporated herein, constitutes the entire agreement between the parties with respect to matters expressly addressed herein and supersedes any prior representations or agreements relating to those matters.
