Default and Acceleration: Upon Borrower’s failure to cure a material default after any required notice and opportunity to cure, Lender may declare the entire unpaid principal balance, accrued interest, escrow advances and other charges immediately due and payable and may exercise all remedies provided by law and this Agreement, including foreclosure.

Security Interest and Assignment

As security for the obligations under this Agreement, Borrower grants, bargains, conveys and assigns to Lender a mortgage, deed of trust, or security deed (as required by local law) on the Property described above. Borrower acknowledges that the mortgage or deed of trust may be assigned by Lender and that the loan may be insured by the Federal Housing Administration in accordance with FHA program requirements.

Borrower represents and warrants that all information provided to Lender to obtain this mortgage loan is true, complete and correct. Borrower certifies that funds will be used for the purpose stated in the loan application and that Borrower will comply with FHA program requirements applicable to this loan, including those related to occupancy, property condition, and mortgage insurance.

Miscellaneous Provisions

Governing Law: This Agreement is governed by the laws of the state in which the Property is located, except to the extent federal law preempts state law. Time is of the essence in Borrower’s performance of all obligations.

Attorney’s Fees: In the event of any action or proceeding to enforce this Agreement, the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs.

Acknowledgment and Certification
