FHA Appraisal and Minimum Property Standards

Buyer and Seller acknowledge that FHA requires the Property to meet HUD/FHA Minimum Property Standards (MPS) and that the FHA appraisal may identify required repairs, unsafe conditions, health or safety deficiencies, or hazards that must be corrected as a condition of FHA insurability. Seller agrees to complete or cause to be completed, prior to FHA mortgage endorsement, the repairs required by FHA in accordance with the provisions below.

Default, Remedies, and FHA Contingency

If Seller fails to complete FHA-required repairs within the agreed time or refuses to cooperate in an escrow holdback approved by the parties and the lender, Buyer may elect to: (a) terminate the Purchase Agreement in writing and receive return of deposits; or (b) waive the repairs and proceed to closing if permitted by FHA; or (c) pursue specific performance or other remedies available at law or equity. The parties acknowledge that FHA loan approval and the FHA appraisal are conditions precedent to Buyer's obligation to close under the Purchase Agreement.

Seller certifies that, to the best of Seller's knowledge: (a) there are no outstanding notices of code violations affecting habitability; (b) there are no undisclosed material defects that would render the Property ineligible for FHA mortgage insurance; and (c) any repairs required by the FHA appraisal will be performed in a workmanlike manner by licensed contractors where required by law.

Governing Law; Entire Agreement
