What a Film Tour Agreement Covers

A Film Tour Agreement is a written contract that sets the terms between a film production (producer) and a location owner, venue, or tour operator when a filming crew will visit a property for scouting, shooting, or producing publicity tours. It defines permitted activities, dates and times, compensation, insurance and indemnity obligations, access rules, equipment and parking arrangements, and any required releases from individuals appearing on camera. The agreement helps manage liability, protect intellectual property and clarify logistical responsibilities for both parties before, during, and after the film-related visit.

Why a Film Tour Agreement Matters

The Film Tour Agreement reduces operational risk and prevents misunderstandings by documenting permissions, insurance coverage, compensation, and shoot logistics. It creates enforceable expectations for access and use, streamlines coordination among production and location staff, and clarifies post-production rights and releases.

Why a Film Tour Agreement Matters

Who Typically Prepares and Signs This Agreement

Who commonly completes a Film Tour Agreement and why they are involved during filming, scouting, or promotional tours.

  • Film producers or location managers coordinating access, schedules, and insurance for shoots and scouting visits.
  • Property owners or venue operators setting conditions for use, compensation, and on-site restrictions.
  • Tour operators, publicists, or location scouts arranging guided tours, publicity shoots, and talent access.

Small production companies, location scouts, legal counsel, and venue staff should review and sign to confirm mutual expectations.

Core Sections to Include in the Agreement

Critical sections of a Film Tour Agreement define rights, responsibilities, insurance, indemnity, compensation, access, and intellectual property to prevent disputes and protect parties.

Parties

Identify the producer, location owner, and any third-party tour operator with full legal names and contact information; specify roles and designated representatives for on-site decisions.

Scope

Describe permitted activities (scouting, filming, publicity), exact dates and times, areas of access, and limits on equipment, parking, and crew size to avoid ambiguity during visits.

Compensation

Specify fees, payment schedule, deposits, reimbursement for damages, and invoicing details. Include late payment remedies and conditions under which fees are refundable or forfeited entirely.

Insurance

Require commercial general liability, additional insured endorsements, and proof of workers' compensation and automobile coverage as applicable. State minimum limits and certificate-holder name and address.

Indemnity

Allocate responsibility for claims, losses, and third-party demands. Include survival clauses, limitations on liability, and procedures for tendering defense and control of litigation and indemnification.

Intellectual Property

Define ownership or license of footage, stills, and promotional materials. Specify permitted use, distribution rights, approval processes, and credits to be issued to location owners.

Common Pitfalls to Avoid

  • Omitting insurance endorsements or failing to name the location owner as additional insured leaves property owners exposed and can void coverage for damages arising from the production.
  • Using vague descriptions of permitted activities or access areas leads to disputes about where crews may operate and whether particular shots or promotional tours are authorized.
  • Failing to document parking, load-in times, or equipment storage provisions causes logistical delays, neighbor complaints, and unexpected costs during production days.
  • Not clarifying intellectual property rights for footage or promotional images can lead to later disputes over distribution, licensing fees, or usage restrictions.

Consequences of an Incorrect or Incomplete Agreement

Breach Liability: Monetary damages possible.
Insurance Denial: Claims denied for noncompliance.
Permit Violations: Local fines and work stoppage.
Property Damage: Repair and replacement costs.
Reputational Risk: Publicity harm to parties.
Contract Termination: Forfeited deposits and fees.

Use-Case Examples for Film Tour Agreements

Real-world examples show how Film Tour Agreements resolve logistics, liability, and IP for diverse production scenarios.

Independent Producer

An independent producer secured a city museum for a one-day shoot by presenting a clear Film Tour Agreement outlining hours, equipment limits, and insurance verification.

  • This reduced negotiation time and expedited approvals.
  • Because the agreement named the municipality as additional insured and specified load-in windows and noise limits, the producer avoided permit delays, reduced venue concerns, and retained the deposit while maintaining positive relations with the location manager.

University Film Class

A university film program used a standardized Film Tour Agreement template for class projects to ensure FERPA compliance, parental releases for minors, and campus security coordination.

  • This streamlined approvals and reduced administrative overhead.
  • Standardized fields for consent, student privacy, and designated campus liaisons allowed timely scheduling, consistent insurance verification, and a single archived file per shoot for the department's records and accreditation needs.
