Issuer assumes no liability for Client's failure to disclose the nature of waste or to comply with legal requirements.

Hazardous Materials Surcharge: Where wastes are classified as hazardous or otherwise subject to higher disposal costs, Issuer reserves the right to apply surcharges to recover actual increased costs. Such classification and associated charges will be determined by Issuer in accordance with applicable regulatory definitions and disposal facility requirements.

Adjustments and Audit: Issuer may adjust charges if subsequent sampling, testing, or third-party billing demonstrates inaccuracies. Client must notify Issuer in writing of any billing disputes within 30 days of Invoice Date; failure to timely dispute constitutes acceptance of charges. Issuer may audit Client records to confirm waste characterization and volumes; Client shall provide reasonable access and cooperation.

Indemnity and Limitation of Liability: Client shall indemnify, defend, and hold Issuer harmless from any claims, liabilities, fines, or penalties arising from Client's breach of representation, mischaracterization of waste, or failure to comply with laws. Issuer's liability for any claim arising from this charge shall not exceed the amount actually paid on this invoice and shall exclude consequential damages.
