By submitting this Draw Request, Borrower certifies and warrants to the Lender as follows: All work for which disbursement is requested has been performed in accordance with the plans, specifications and the Loan Agreement; the amounts listed herein are true and correct; no portion of this Draw has been the basis of any prior disbursement except as identified; all subcontractors and suppliers have been paid or will be paid from the proceeds of this Draw as required by applicable contracts and lien law; all necessary permits and inspections have been obtained or scheduled.

Borrower acknowledges that disbursement is subject to the Lender's review and verification of submitted documentation and satisfaction of all conditions precedent in the Loan Agreement, including but not limited to receipt of original conditional and/or unconditional lien waivers, executed change orders, final invoices, and satisfactory inspections.
