TERMS, AUTHORIZATION, AND LIABILITY

1. Authorization: The Remitter hereby authorizes the carrier or authorized agent to collect the Total Amount Due from the Consignee at time of delivery on behalf of the Remitter and to remit collected funds to the Remitter in accordance with these instructions. Remitter warrants that it has authority to direct collection and to receive funds on the referenced account.

2. Collection and Fees: The carrier may apply a COD handling fee as indicated above. The carrier's acceptance of payment instruments (cash, certified check, card) is subject to carrier policy; the Remitter agrees that the carrier may endorse and deposit instruments and will not be liable for theft or loss after lawful receipt and deposit by carrier or its bank.

3. Refusal and Return: If the Consignee refuses delivery or payment, the carrier may return the shipment to Remitter at Remitter's expense. Remitter agrees to pay reasonable costs of return, storage, and reconsignment, and any unpaid COD balance.

4. Remittance: Carrier will remit collected funds to Remitter within the carrier's standard remittance cycle. Remitter's remittance instructions are provided in this form and may include bank account information for electronic transfer. Carrier will not be liable for remittances made in accordance with provided instructions unless caused by carrier's gross negligence.

5. Default and Interest: Unpaid COD amounts returned to Remitter remain the responsibility of the Remitter. Any amounts owed by Remitter to carrier (including fees) that remain unpaid after invoicing shall bear interest at the lesser of 1.5% per month or the maximum lawful rate.

6. Indemnity and Governing Law: Remitter agrees to indemnify and hold carrier harmless from claims related to collection instructions, nonpayment by Consignee, or disputes over delivered goods, except where carrier's gross negligence is the sole proximate cause. This agreement shall be governed by the laws applicable to the carrier's terms of service and the jurisdiction specified on invoice or bill of lading.
