Default occurs upon failure to make any scheduled payment within days after the due date, or upon Buyer insolvency or breach of any material representation. Upon default Seller may accelerate the unpaid balance, repossess the financed device as provided by law, and pursue all available remedies including collection costs, attorneys' fees, and legal interest.

Buyer represents and warrants that the information provided is true and complete, Buyer has authority to enter into this Agreement, and Buyer will notify Seller promptly of any change in contact or payment information. Buyer expressly authorizes the Seller to obtain credit reports and to report payment performance to credit repositories.

Governing Law & Miscellaneous

This Agreement will be governed by and construed in accordance with the laws of the state where the Seller maintains its principal place of business, except to the extent federal law applies. Buyer may not assign this Agreement without Seller's prior written consent. Seller may assign its rights and obligations in whole or in part. This Agreement constitutes the entire agreement between the parties with respect to the sale and financing of the device and supersedes prior oral and written agreements.
