Security, Insurance and Lien

Security deposit shall be held as security for performance and may be applied to unpaid charges. The Parking Operator retains a contractual lien against the vehicle for unpaid parking charges and may exercise all lawful remedies to satisfy indebtedness, including repossession of vehicle access privileges. Use, Maintenance and Responsibility

Client is responsible for removal of hazardous materials and for any damage caused by Client or Client's invitees. Parking Operator is not responsible for theft, loss, or damage to vehicle except where caused by Parking Operator's gross negligence.

Default, Remedies and Termination

Failure to pay any amount when due constitutes default and entitles Parking Operator to suspend access, apply security deposit, terminate this Agreement and recover all unpaid charges, costs of collection, and reasonable attorneys' fees. Either party may terminate for material breach following written notice and failure to cure within 10 days. Early termination by Client may not relieve Client of payment obligations for the remainder of a fixed term if specified in this Agreement.

All notices required under this Agreement shall be in writing and delivered to the addresses provided below. Notices are effective upon personal delivery, confirmed electronic delivery, or three business days after deposit in the U.S. mail, postage prepaid.
