DEFAULT AND REMEDIES

If Borrower fails to perform any obligation under this Agreement, including timely payment of amounts due under the Repayment Schedule, such failure shall constitute an Event of Default. Upon Event of Default, Lender shall have the right to terminate forbearance, accelerate all amounts due, and pursue all remedies available under the loan documents and applicable law. Lender’s forbearance is conditioned upon Borrower’s full compliance with this Agreement; relief provided hereunder is not a waiver of any right except as expressly stated.
