Definitions

For purposes of this Agreement, "Nonpublic Personal Financial Information" means any information about Client that a financial institution obtains in connection with providing a financial product or service, including but not limited to account balances, transaction history, credit history, tax identification, income, account numbers, and related personally identifying information.

Scope of Collection and Use

Client authorizes the Financial Institution to collect, retain, and use Nonpublic Personal Financial Information as necessary to open, maintain, service, and enforce Client accounts and to evaluate and process transactions. Collection may include information provided directly by Client and information obtained from third-party sources in connection with account maintenance, credit investigation, and fraud prevention.

Disclosure and Sharing

The Financial Institution may disclose Nonpublic Personal Financial Information to affiliates, service providers, regulatory authorities, third-party processors, and other permitted recipients for servicing, administrative, audit, compliance, and fraud-prevention purposes. Such disclosures are limited to the minimum information necessary for the recipient's authorized purpose and are subject to contractual confidentiality obligations where applicable.

I consent to the Financial Institution sharing Nonpublic Personal Financial Information with its affiliates as described above. I do not consent to such sharing except as required or permitted by law.

I consent to the disclosure of Nonpublic Personal Financial Information to third parties for marketing purposes. I do not consent to such marketing disclosures.

Safeguards; Security Measures

The Financial Institution will maintain reasonable physical, electronic, and procedural safeguards designed to protect Nonpublic Personal Financial Information against unauthorized access, disclosure, alteration, and destruction. These safeguards shall be appropriate to the sensitivity of the information and shall comply with applicable law.

Retention, Access, and Correction

The Financial Institution will retain records containing Nonpublic Personal Financial Information for the period necessary to fulfill the purpose for which the information was collected and to satisfy legal and compliance obligations. Client may request access to or correction of Personal Financial Information by submitting a written request to the Financial Institution at the address shown below; the Financial Institution will respond in accordance with applicable law.

Required Disclosures

Notwithstanding any contrary provision, the Financial Institution may disclose Nonpublic Personal Financial Information to the extent required by law, court order, or governmental authority, and in response to lawful subpoenas or similar legal process.

Amendment; Governing Law; Severability

The Financial Institution reserves the right to amend this Agreement. Any amendments will be effective as permitted by law and will not reduce protections applicable to information already collected without prior notice. This Agreement shall be governed by the laws of the jurisdiction in which the Financial Institution's principal office is located. If any provision is held invalid, the remaining provisions shall remain in full force and effect.
