Borrower represents and warrants that all information provided to Lender relating to the Borrower’s financial condition and collateral is true, correct and complete as of the Effective Date. Borrower covenants to maintain insurance and preserve the priority of any security interests as required by the Original Agreement and this Renewal Agreement.

Default and Remedies

If Borrower fails to make any payment when due or otherwise defaults under the terms of this Agreement or the Original Agreement, the Lender may, at its election, declare the entire outstanding principal and accrued but unpaid interest immediately due and payable and pursue all remedies available under law or equity, including foreclosure on collateral and collection of costs and attorney’s fees as permitted by law.

All notices required or permitted hereunder shall be in writing and delivered to the addresses set forth in the Parties section or such other address as either party designates in writing. Notices are effective upon receipt.
