By submitting this application and signing below, Applicant certifies under penalty of perjury that: the information provided in this application is true, accurate and complete; requested funds will be used only to subsidize wages of the employees identified in this application during the support period; wages supported will be recorded in Applicant payroll records and reported as required by applicable laws; and Applicant will comply with all program terms set forth in this Agreement.

Use of Funds: Funds disbursed under this program may be used only to pay wages, payroll taxes and required benefits for the covered employees listed above. Use of funds for any other purpose constitutes material breach and requires immediate repayment.

Records and Audit: Applicant must retain payroll records, time sheets, tax filings and any supporting documentation for a minimum of three years following final payment. Applicant consents to audit and inspection by the administering authority or its designees and agrees to cooperate with any review of fund usage. Failure to produce records upon request constitutes an event of default.

Repayment and Clawback: If Applicant uses funds in violation of this Agreement, submits false statements, or fails to maintain required employment or documentation, Applicant shall promptly return the funds to the administering authority upon demand, together with interest at the applicable statutory rate and any collection costs.

False Statements and Penalties: Applicant acknowledges that knowingly making false statements or omissions in connection with this application may subject Applicant to civil and criminal penalties under applicable law.

Compliance with Law: Applicant shall comply with all federal, state and local laws applicable to employment, wages, withholding, tax reporting, nondiscrimination and workplace safety. Nothing in this Agreement relieves Applicant of obligations under applicable law.

Indemnification: Applicant agrees to indemnify and hold harmless the administering authority and its officers, employees and agents from any claim, loss or liability arising from Applicant’s use of funds, breach of this Agreement or misrepresentation in this application.

Governing Law and Remedies: This Agreement is governed by the laws of the jurisdiction that administers the program. Remedies for breach include, but are not limited to, demand for repayment, offsets against other public funds, and referral for civil or criminal prosecution.
