What the Fingerprint Release Form Is and When it’s Used

A Fingerprint Release Form authorizes an individual to collect, use, or transmit their fingerprint data for background checks, licensing, employment screening, or legal processes. The form documents consent, identifies the requesting agency or employer, specifies the purpose and retention period, and includes certifications about accuracy. Because fingerprints are biometric personal data, the form should state who will receive the prints, how they will be stored, and whether information will be shared. Properly completed releases help organizations meet privacy, employment, and licensing requirements while providing clear evidence of informed consent.

Why a Clear Release Form Matters

A well‑drafted Fingerprint Release Form documents consent, reduces disputes about authorization, and clarifies scope and recipients of biometric data. It also supports regulatory compliance where biometric data handling is regulated and preserves audit evidence for background checks and licensing reviews.

Why a Clear Release Form Matters

Who Typically Completes a Fingerprint Release Form

Organizations and individuals use this form when fingerprints are required for background checks, licensing, or legal discovery. Common initiators include employers, licensing boards, courts, and background screening vendors.

  • Employers performing pre‑employment background checks or periodic screenings of employees.
  • Licensing boards and regulatory bodies requesting biometric data for credentialing or renewal.
  • Background screening firms and law enforcement agencies collecting prints for investigation or records.

The signer should be the subject of the fingerprints or a legally authorized representative; providers must retain proof of identity and the signed release.

Who Signs and Who Authorizes

Individual Signer

The person whose fingerprints are collected must sign unless a court or statute permits a guardian or authorized agent to sign on their behalf. The signer must provide a printed legal name and a government‑issued ID to match identity information.

Requesting Entity

An employer, licensing board, or law enforcement agency requests the fingerprinting and certifies purpose on the form; the entity is responsible for secure transmission and retention consistent with applicable law.

Step-by-step: How to Complete the Fingerprint Release Form

Follow these steps in order to ensure the form is complete, verifiable, and accepted by the requesting body.

  • 01
Prepare ID: Gather a government ID to confirm name and date of birth at collection.
  • 02
Confirm Purpose: Verify the specific reason fingerprinting is required and list it on the form.
  • 03
Complete Fields: Enter all required fields using specified formats and include contact details.
  • 04
Sign and Date: Sign in ink or use an accepted eSignature method and record the date.

Typical Workflow: From Request to Processed Background Check

Understanding the common routing steps helps set expectations for timing and responsibility for each party involved.

  • Submission: Requester provides form and instructions to the individual.
  • Collection: Fingerprints are captured by a trained technician or authorized vendor.
  • Transmission: Prints and release are securely transmitted to the designated agency or vendor.
  • Resulting Report: Agency returns background check results to the requester per agreed channels.

What a Professional Fingerprint Release Form Should Include

A complete release form combines identity data, a clear consent clause, purpose, recipient details, retention terms, and authentication to ensure validity and defensibility.

Identity Details

Full legal name, DOB, address, and government ID type and number to match biometric records and reduce false matches during verification.

Consent Language

Clear, unambiguous authorization that explains the scope, purpose, and recipients of fingerprint data and acknowledges voluntary consent.

Purpose Clause

A specific description of why fingerprints are collected (employment, licensing, background investigation) and how results will be used in decision making.

Recipient Information

Name and contact details of the agency or vendor receiving prints, plus any third parties who may access the data for processing.

Retention and Disposal

How long prints will be stored, procedures for secure disposal, and any rights to request deletion or correction where applicable.

Authentication

Signature block (wet or electronic), date, and a place for witness or notary information when state or agency rules require notarization.

Security and Compliance Elements to Note

Data Encryption: AES-256 at rest, TLS 1.2/1.3 in transit
Audit Trail: Timestamps and IP logs
HIPAA Support: BAA required for PHI handling
21 CFR Part 11: Compliant options available
SOC 2: SOC 2 Type II certified
Accessibility: WCAG 2.0 Level AA support

Common Errors to Avoid When Preparing the Form

  • Using a nickname or abbreviated legal name that does not match government ID can cause mismatches and rejection.
  • Leaving the purpose or recipient field vague creates compliance risk and may lead to refusal by the processing agency.
  • Failing to include a date or signing in the wrong place invalidates the authorization in some jurisdictions.
  • Notarization or witness rules overlooked: some states require notarized consent or witness signatures for certain releases.

Penalties and Risks of an Incorrect or Missing Release

Processing Delays: Extended verification time
Report Rejection: Agency may decline to process
Regulatory Risk: Noncompliance with HIPAA
Legal Challenge: Consent disputes in litigation
Employment Impact: Delayed hires or rescinded offers
Fines: Civil penalties for privacy breaches

How to Configure a Digital Fingerprint Release Workflow

Typical configuration settings for an electronic workflow help ensure identity verification, consent capture, and secure delivery.
