What a Fixed Term Lease Agreement Is and When It Applies

A Fixed Term Lease Agreement is a written contract that sets a defined start and end date for rental occupancy, allocates rent and security deposit obligations, and records each party's rights and responsibilities for the term. It typically covers premises description, rent amount and due dates, utilities and maintenance obligations, default and remedies, subletting rules, and move-out procedures. For leases longer than one year it satisfies statute-of-frauds requirements and may be recorded; signatures, dates, and accurate party names are essential for enforceability and third-party notice purposes.

Why a Clear Fixed Term Lease Agreement Matters

A precise lease reduces disputes, clarifies payment and repair obligations, and creates enforceable timelines for possession and termination under contract law.

Why a Clear Fixed Term Lease Agreement Matters

Who Typically Prepares and Signs This Lease

Landlords, property managers, and tenants use fixed term leases to set predictable tenancy windows and financial obligations.

  • Property managers administering multiple units and renewal workflows for owner clients.
  • Individual landlords documenting a single rental unit or seasonal residence occupancy.
  • Tenants needing written proof of occupancy term, rent amount, and refund conditions.

Proper completion benefits both sides by establishing clear expectations, reducing litigation risk, and documenting compliance with local law.

Step-by-Step: Completing a Fixed Term Lease

Follow these sequential steps to draft, confirm, and execute a legally sound fixed term lease for residential or commercial premises.

  • 01
Draft the Agreement: Populate parties, premises, term, and rent details.
  • 02
Review Local Rules: Confirm state and municipal landlord-tenant requirements.
  • 03
Add Signatures: Obtain signatures and dates from all parties.
  • 04
Store Copies: Provide executed copies to tenant and landlord.

Where to Send and File the Executed Lease

After execution, confirm distribution and storage steps so each party has an enforceable copy and any required filings are completed.

  • Tenant Copy: Provide a signed copy to the tenant immediately.
  • Landlord Records: Keep the original signed agreement in landlord files.
  • Property Manager: Upload to the management system or portfolio repository.
  • County Recording: Record only if local law or lease duration requires public notice.

Configuring an Online Signing Workflow for a Lease

Set up a clear signing order, authentication level, and storage location to minimize signer friction and maintain auditability for the executed lease.

Field Configuration
Signature Order Tenant first | Landlord second
Authentication Email link plus optional SMS code
Reminders Automated reminders at 3 and 7 days
Storage Location Cloud folder with versioned audit trail

Digital Tools and File Formats to Use

Use standard document formats and integrations to streamline signing, storage, and recordkeeping.

  • File Formats: PDF and DOCX supported
  • Integrations: Google Workspace, Microsoft 365, NetSuite
  • Authentication Options: Email, SMS code, SSO

Key Dates and Timing to Track in a Lease

Track rent schedules, notice periods, and statutory timelines to ensure compliance and avoid penalties.

Rent Due Date:

Specify monthly due date (example: 1st of each month).

Security Deposit Return:

Typically 14–60 days depending on state law.

Notice to Vacate:

Standard 30- or 60-day notice depending on term.

Lease Renewal Deadline:

Set notice period for renewal or nonrenewal.

Repair Response Time:

Define landlord response time for urgent repairs.

Notarization and Witness Steps (When Required)

Some leases and associated documents may require notarization or witnesses; follow a clear signing and authentication sequence when that applies.

01

Prepare Final Document

Ensure all blanks are filled before signing.

02

Sign in Presence

Signers must appear before notary or witnesses.

03

Notary Acknowledgement

Notary completes acknowledgement and signs.

04

Witness Attestation

Add witness signatures when state requires them.

05

Record If Needed

Record lease in county if statutory notice required.

06

Retain Notary Journal

Notary retains journal per state rules.

07

RON Option

Use Remote Online Notarization where permitted.

08

Leases over one year generally must be written.

Core Sections Every Professional Fixed Term Lease Should Include

A complete fixed term lease organizes obligations and remedies so both parties understand coverage for the entire tenancy.

Parties

Full legal names and contact details for landlord and each tenant, including entity information for corporate owners and authorized signatories.

Premises

Clear property description and unit identifiers; include parking, storage, and any exclusive or shared spaces to avoid future disputes.

Term

Exact start and end dates, any early termination rights, holdover terms, and conditions for renewal or extension.

Rent

Amount, due date, acceptable payment methods, grace period, late fees, returned-check penalties, and rent escalation formula if applicable.

Security Deposit

Amount, permitted deductions, interest handling where required, and the timeline and method for refund following move-out.

Maintenance

Allocation of repair responsibilities, notice procedures for maintenance requests, and prohibited tenant modifications without consent.

Security and Compliance Features to Look For

In-transit encryption: TLS 1.2 / 1.3
At-rest encryption: AES-256 encryption
Audit Trail: Timestamped signing events
Legal Compliance: ESIGN and UETA support
HIPAA Options: BAA available where required
Access Controls: Role-based permissions

Common Risks and Consequences of Errors

Late Rent Charges: Enforceable if disclosed
Security Deposit Disputes: State timelines limit claims
Invalid Parties: Mismatched names weaken enforcement
Missing Term Dates: Creates ambiguity on possession
Unlawful Clauses: May be severed or voided
Failure to Record: Third-party priority issues

Frequent Preparation Mistakes to Avoid

  • Using informal or abbreviated legal names that do not match government IDs, causing service or enforcement problems.
  • Omitting specific payment methods or due dates, creating disputes about when rent is considered paid.
  • Failing to state maintenance responsibilities, which leads to conflicting repair claims and unplanned expenses.
  • Neglecting statutory notice periods for termination or deposit accounting, producing penalty exposure under state law.

Typical Signers and Their Authority

Landlord

The landlord or authorized representative signs to create the tenancy; if a business entity is landlord, an officer or authorized agent must sign and identify title to show signing authority.

Tenant

Each tenant named on the lease must sign and date; co-tenants have joint obligations unless the lease specifies individual liability or separate units.
