. . . . F . . . . . . . . Summary of defendant's case and evidence a. Plaintiff's claims 1. Plaintiffs claim that the following statements were false and made with malice: a. "i didn't make the decision to give him [mr. Anderson] the medicine." b. "i have to give him [mr. Anderson] a medicine to make sure he gets up." c. "i can't just stop him. I have some things to do before i can call him." d. "they'll put him away, anyway, if i don't give him the medicine." e. "i know that i made a mistake to give him the medicine, but I don't blame the police. I never said that." f. "she [mrs. Anderson] would have gotten up." g. "they didn't give her any medicine; she just got up." h. "mrs. Anderson had to go outside; she had to go to the bathroom and take a bath. She just kind of got up and put her hand down her pants, she put her hand down a man's pants, and she put some pills in his mouth, and he died." i n the face of the evidence, this claim fails for several reasons: a. The statements in the first three paragraphs were not false claims, but they were unsupported. While they are clearly not made with actual malice, plaintiffs have failed to show that these statements were made with facts and circumstances showing actual malice, thereby rendering these statements false. Plaintiffs have failed to show that statements in paragraph four were reasonably believed to be true by the defendants. As discussed above, there's absolutely no evidence of Mrs. Anderson entering her house, walking to a backroom and giving Mr. Jones pills. As a matter of law, the statements made in paragraph four could not reasonably be believed as true by the defendants. B.
