1 Easement for Telephone Facilities THE STATE OF TEXAS §KNOW ALL MEN BY THESE PRESENTS: COUNTY OF §That , hereinafter called Grantor, for a good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby, grant unto //// whose post office address is , hereinafter called Grantee, and to its agents, lessees, successors and assigns an easement and the right-of-way of the undersigned situated in the County of , State of , and more particularly described as follows: and to construct, reconstruct, add to, diminish, operate and maintain on, over, above described lands and/or in upon or under all streets, roads, or highways, abutting said lands, a telephone line, telephone lines or communication system or systems consisting of cables, wave guides, wires, conduits, markers, and other appurtenances as the Grantee may from time to time require; together with the right of ingress and egress over my (our) adjacent lands, and right to install and maintain a lock on any locked gate across such means of ingress and egress over my (our) adjacent lands or my right-of-way easements to said lands.This is a grant of an easement which it is agreed and understood will be feet in width and will become a permanent easement with the center line, when possible, along the course of the line or lines when the same are in place, the easement generally to be feet inside the boundary fence line. Grantee shall have the right to select the route upon which all telephone and other lines or cables are laid and constructed under this agreement with the express understanding that where possible, the line or cable will be installed or constructed approximately feet inside the boundary fence line. It is agreed and understood that any telephone cable or cables which may be buried pursuant to the terms of this agreement shall be buried below plow depth, which is agreed to be not less than inches in depth. Grantee shall have the right to cut, trim and remove, now or hereafter, bushes, trees and all other obstructions that may interfere with the rights granted.Grantee agrees that a clean-up crew will follow the construction crew and attempt to leave the surface of the above described land in substantially the same condition as it exists immediately prior to the beginning of the construction operation. 2Grantor agrees that all poles, wires, cable and other facilities, including all telephone equipment installed on or under the above described premises at Grantee’s expense shall remain the property of and be removable at the option and expense of the Grantee.Grantee agrees to pay for any damages to fences, growing crops, improvements and timber, except timber trimmed, of Grantor arising from the exercise by Grantee of the rights herein granted.Grantor retains the right to fully enjoy and use the above described lands and that the lands are free and clear of encumbrances and liens of whatsoever except those held by the following person or persons: whose address is: // .
