What Form I-751 is and when it applies

Form I-751, Petition to Remove Conditions on Residence, is the USCIS form used by conditional permanent residents who obtained status through marriage to request removal of the two-year conditions on their lawful permanent resident status. You must file this petition jointly with the spouse who granted the conditional status or, in certain hardship or abuse cases, file a waiver. The form documents continued marital bona fides or qualifying exceptions, triggers USCIS review and biometrics, and starts the process to receive a ten-year permanent resident card if approved.

Why timely and accurate Form I-751 filing matters

Filing Form I-751 removes the two-year condition on marriage-based residency, converting conditional status into a ten-year green card when approved. Timely and complete filings avoid removal proceedings and work-authorized interruptions; the petition also allows biometrics and an interim extension of status while USCIS adjudicates.

Why timely and accurate Form I-751 filing matters

People and professionals who commonly use Form I-751

Who files Form I-751: conditional permanent residents with marriage-based status approaching their two-year anniversary of admission.

  • Conditional resident filing jointly with sponsoring spouse to remove conditions within the 90-day window.
  • Surviving spouse or divorced spouse seeking a waiver due to death, divorce, or extreme hardship.
  • Victims of abuse or battery applying for a waiver without the spouse as joint petitioner.

Cases also include special immigrant juveniles and other limited circumstances where conditional status removal follows specific USCIS standards.

Core sections and supporting items to include with the petition

Key sections in Form I-751 collect petitioner details, information about the qualifying marriage, evidence of bona fide relationship, waiver claims, payment and biometrics, and the required attestations and signatures.

Petitioner Details

Provide the conditional resident's full legal name, A-number, date of birth, current address, and USCIS receipt numbers. Accuracy here ensures consistent identity matching across USCIS records during adjudication.

Spouse Information

Enter spouse's full name, immigration status, and contact information. If spouse is unavailable, explain circumstances and attach supporting documentation such as death certificate or divorce decree.

Evidence of Marriage

Attach joint financial records, leases, insurance policies, photographs, affidavits from third parties, joint tax returns, and any documents showing a shared life to establish the marriage was entered in good faith.

Waiver Grounds

If filing a waiver, specify the legal basis—death of spouse, divorce, abuse, or extreme hardship—and include corroborating evidence such as police reports or medical records.

Fees & Biometrics

Include the appropriate USCIS fee or fee waiver request and pay a biometric services fee when required; USCIS will notify applicants for fingerprints and photographs.

Attestation & Signature

All qualifying parties must sign, date, and certify the truthfulness of statements under penalty of perjury. Unsigned or improperly dated petitions risk rejection.

Required identifiers and data fields

Alien Number: USCIS A-number from prior notices.
Full Legal Name: Exactly as on passport or ID.
Date of Birth: Enter using MM/DD/YYYY format.
Marriage Date: Provide MM/DD/YYYY and marriage place.
Current Address: Street, city, state, ZIP required.
Supporting Docs: List and attach primary evidence types.

Consequences of errors or late filing

Late Filing: May trigger removal proceedings.
Insufficient Evidence: Possible denial for lack of proof.
Fraud Findings: Criminal referral and permanent bar.
Incorrect Fees: Filing returned or delayed.
Unsigned Petition: Automatically rejected by USCIS.
Perjury Risk: False statements carry criminal penalties.

Common preparation pitfalls to avoid

  • Waiting until after the conditional green card expires can lead to removal proceedings and loss of employment authorization; file within the 90-day window before expiration.
  • Submitting inadequate joint evidence such as only a single affidavit or isolated receipts often fails to convince USCIS that the marriage was bona fide.
  • Using inconsistent names or failing to include the A-number can cause processing delays or create mismatches in USCIS databases, prolonging adjudication.
  • Relying solely on electronic copies without clear scans, missing pages, or unreadable documents increases the chance of a Request for Evidence (RFE) and additional delays.

Step-by-step filing checklist

Step-by-step: complete Form I-751 fields, assemble evidence, pay fees or request waiver, submit to USCIS, and attend biometrics.

Practical tips to reduce RFEs and speed adjudication

Practical tips improve completeness and reduce RFEs when preparing Form I-751; quality control and organized evidence matter.

Use Consistent Names and Identifiers
Always use the same full legal name, A-number, and dates across all documents. Mismatched names between the petition, passports, and supporting evidence often trigger requests for clarification and slow adjudication—correct at the source before submission.
Organize Evidence by Category and Date
Group documents into labeled tabs or folders—financial records, residence proof, children’s documents, and affidavits. Provide brief cover letters explaining each exhibit bundle to help USCIS officers quickly understand the relationship evidence demonstrates.
Submit Originals or Certified Copies When Necessary
When documents are only available as originals or require certification, submit certified copies or originals with a photocopy. USCIS may request originals at interview; prepare to present originals to avoid delays or credibility questions.
Respond Quickly to Requests for Evidence
If USCIS issues an RFE, follow instructions precisely, submit only requested documents, and include a clear cover letter. Timely and focused responses shorten adjudication and demonstrate good-faith cooperation; consider legal review before responding.
