FOSTER CARE AGREEMENT

This Foster Care Agreement ("Agreement") is made effective as of between the parties identified below.

Parties

WHEREAS

WHEREAS, Placing Agency is responsible for the placement and oversight of children in foster care and has authority to arrange foster placements; and

WHEREAS, Foster Parent has been assessed, approved, and agrees to provide temporary care, supervision, and support for the Child(ren) placed under this Agreement in accordance with applicable laws, licensing requirements, and agency policies; and

NOW, THEREFORE, in consideration of the mutual covenants below, the parties agree as follows.

Scope of Care

Foster Parent shall provide safe, appropriate, and nurturing care consistent with the best interests of the child(ren) placed, including, but not limited to, daily supervision, meals, transportation to required appointments, school attendance support, and communication with Placing Agency regarding the child(ren)'s health and well-being. Specific responsibilities and any special requirements for the child(ren) placed under this Agreement are described below:

Payment Terms

Placing Agency shall compensate Foster Parent for foster care services as follows.

All payments shall be made to Foster Parent within the period specified in the Payment Schedule following receipt of a proper statement or invoice. Placing Agency may withhold funds pending verification of services or where required by court or regulatory directive.

Term and Termination

This Agreement shall commence on and continue until unless terminated earlier in accordance with this Section.

Either party may terminate this Agreement for material breach, loss of required licensing, failure to comply with mandatory reporting obligations, or if continued placement would pose an immediate risk to the health or safety of the child(ren). Termination for cause is effective immediately upon written notice; termination for convenience requires the notice period specified above.

Confidentiality

Foster Parent shall maintain the confidentiality of all records and information regarding the child(ren) and their families, except as required by law, court order, or for the provision of necessary services. Confidential information shall not be disclosed to third parties without prior written authorization from Placing Agency or as otherwise permitted by statute. This obligation survives termination of this Agreement.

Background Checks and Compliance

Foster Parent affirms that all required background checks, clearances, and training have been completed and will be maintained in active status for the duration of this Agreement. Foster Parent agrees to comply with all applicable licensing, health, and safety standards and to cooperate with Placing Agency and authorized monitors in inspections or reviews.

Records and Reporting

Foster Parent shall keep accurate, contemporaneous records of incidents, healthcare events, educational matters, and other material occurrences affecting the child(ren) and shall report to Placing Agency promptly as required by agency policy or applicable law. Foster Parent consents to reasonable requests for such records by Placing Agency or authorized representatives.

Liability; Insurance; Indemnification

Each party shall maintain appropriate insurance coverage as required by law and agency policy. Foster Parent shall exercise reasonable care for the child(ren) placed and agrees to indemnify and hold harmless Placing Agency from claims arising from Foster Parent's gross negligence or willful misconduct. Placing Agency shall indemnify Foster Parent for claims arising from placement decisions or agency directives inconsistent with this Agreement or law.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state specified below.

Entire Agreement; Amendment; Severability

This Agreement contains the entire understanding of the parties with respect to the subject matter and supersedes all prior discussions, representations, or agreements. Any amendment to this Agreement must be in writing and signed by both parties. If any provision of this Agreement is held invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect.

Acknowledgments

Both parties acknowledge that they have the authority to enter into this Agreement, have read and understand its terms, and will perform their obligations in good faith and in accordance with applicable law and agency policy.
