IN THE CHANCERY COURT OF COUNTY, MISSISSIPPI IN THE INTEREST OF , A MINOR PETITION FOR TERMINATION OF PARENTAL RIGHTS COMES NOW, Next Friend and Natural father/mother of , and files this his/her Petition for Termination of Parental Rights of and his/her natural son, , pursuant to §93-15-103(e), and would respectfully show unto the Court the following: I. That is the minor child having been born , , and is the natural child of and . II. That heretofore on the day of , , a Default Judgment on Petition for Filiation was entered against in the Chancery Court of County, Mississippi, and the care, custody and control of the minor child was vested in with rights of visitation reserved unto the father/mother. III. That for the last several years there has developed an extreme and deep-seated antipathy by the child toward the natural mother/father and there is other substantial erosion of the relationship between the child and the natural mother/father which was caused at least in part by the said natural mother/father's serious neglect, prolonged and unreasonable absence, his/her unreasonable failure to visit or communicate. Further, the natural mother/father has neglected to pay any
Maintenance to the child. Further, the natural mother/father has also failed to provide financial support to the natural father/son for the remainder of the statutory period for support due to him. And, that the natural mother/father has, upon discovery to the contrary, willfully destroyed all records and documents required here under Mississippi code, section 73-15-13, and the child has been permanently deprived of his/her legal rights here below, and hereof and thereby the following facts are established to the court: i. That on the 7th day of july 2010 between the hours of 10:00pm and 11:00pm, the child received a telephone call from the mother/father to the effect that if the boy, the natural son the said, did not show up in her room for the night, he would be kicked out by his mother and all visitation would be denied and if the boy was seen with a living family of a family living in a different county of Mississippi, his visitation had to be granted or terminated. On that day at the residence of the boy, the boy was seen by his mom at 11:00pm with relatives of the family living in the state of Mississippi. Ii. At 5:00am on august 22, 2010, at a time the court in all of its authority deems appropriate, the mother/father of the natural son/daughter, upon receipt of a court order granting her visitation rights to and in the absence of a child support arbitrage under mississippi code, § 73-15-13, filed a motion for abolition of visitation to and for custody of the natural son/daughter. As a follow-up to this motion, the mother/ father filed, and was granted a motion for a temporary abolition of visitation due to the mother's financial inability to maintain the support of the biological son. Iii. On July 16, 2011 at 2:00 , the wife of the natural son in accordance with the law, filed a motion to abort as this proceeding is being heard concerning the legal custody of the natural son. Iv. On august 5, 2011 at 6:00 , the mother/father failed to appear and for cause ordered the mother to be arrested for failure to appear. V. On August 19, 2011 at 10:00 am, the mother and family member were heard calling for the mother/ father at the residence, but did not return. On the august 23, 2011 at 7
