The financial institution will exercise reasonable care in executing the transfer but will not be liable for delays or failures caused by circumstances beyond its control, including but not limited to network failures, intermediary bank actions, regulatory holds or routing errors caused by incorrect account identifiers. Any liability of the financial institution for negligent performance shall be limited to direct proven losses and shall exclude consequential damages.
