What the Funeral Home Services Agreement Is

A Funeral Home Services Agreement is a written contract between a funeral home and a client (or the decedent's authorized representative) that documents the services to be provided, pricing, and responsibilities of each party. Typical items include disposition choices (burial, cremation), embalming and preparation, memorial service details, transportation, third-party vendor coordination, and payment or deposit terms. The agreement establishes expectations, timelines, and any regulatory or permit-related responsibilities, and it can be executed on paper or electronically where permitted under federal and state e-signature laws.

Why a Clear Agreement Matters for Funeral Services

A written agreement reduces misunderstandings, documents elected services and costs, and protects both the funeral home and the family. It creates a clear record for billing, regulatory compliance, and any insurance or veterans’ benefits claims, and it clarifies who has authority to make decisions about disposition and final arrangements.

Why a Clear Agreement Matters for Funeral Services

Who Typically Completes These Agreements

Funeral directors or licensed staff complete the agreement with the decedent's next of kin, designated agent, or executor.

  • Funeral home staff and directors coordinating services and obtaining signatures.
  • Immediate family members or authorized agents selecting disposition and service options.
  • Estate executors, insurance representatives, or VA benefits coordinators verifying charges.

Families, legal representatives, and third-party payers reference the signed agreement when confirming services, billing, or benefits claims.

Core Sections to Include in a Professional Agreement

Include clearly labeled sections so responsibilities, costs, and options are easy to find. Each section should be explicit about what is included, excluded, and any additional charges that may apply.

Parties

Identify the funeral home and the contracting individual or authorized agent, including full legal names and contact information for billing and correspondence.

Services

Itemize services (e.g., embalming, viewing, transportation, cremation, burial) with specific descriptions so there is no ambiguity about what is being provided.

Pricing

List itemized prices, required deposits, payment terms, and any third-party vendor costs that the family may be responsible for paying.

Authority

State who has legal authority to make decisions and sign (next of kin, agent, executor) and require documentation of proof of authority when necessary.

Permits

Note responsibility for permits, death certificate copies, cremation authorizations, and any fees associated with municipal or state filings.

Liability

Include limitation of liability, cancellation terms, refund policy, and how disputes will be handled, including governing law selection.

Step-by-Step: Completing the Agreement

Follow a consistent process to gather information, confirm authority, and document selections to avoid delays or misunderstandings.

  • 01
Gather documents: Obtain ID, death certificate info, and proof of authority.
  • 02
Select services: Review package options and itemize any add-ons.
  • 03
Confirm pricing: State deposits and remaining balance clearly.
  • 04
Execute signature: Have authorized signer sign in person or electronically.

  • Funeral home file: Store signed agreement in the permanent client file.
  • Permits submission: Send required permit requests to the local registrar or coroner.
  • Third parties: Share copies with cemeteries, crematories, or clergy as needed.

Typical Timelines and Deadlines to Track

Certain tasks are time-sensitive; track required deadlines to avoid permit delays, missed benefit claims, or extra fees.

Death certificate requests:

Order as soon as practical for burial or cremation permits.

Permit applications:

Submit to local authorities before disposition; timelines vary by county.

VA benefit claims:

File promptly; documentation deadlines may affect eligibility.

Payment due dates:

Enforce deposits and final payments per agreement terms.

Record retention:

Retain executed documents per applicable retention schedules.

Common Mistakes to Avoid When Preparing the Agreement

  • Failing to verify the signer's legal authority can result in delayed disposition or disputes over services and billing.
  • Omitting itemized pricing or third-party vendor fees leads to unexpected charges and billing disputes after services are rendered.
  • Not capturing consent for cremation or disposition in writing can create regulatory noncompliance and operational delays.
  • Using unclear cancellation or refund language increases the likelihood of contested charges and potential legal claims.

Penalties and Risks of an Incorrect or Missing Agreement

Regulatory delay: Permit denial risk
Benefit denial: Insurance/VA claim refusal
Financial liability: Unrecovered vendor costs
Contract disputes: Potential litigation
Fines: State compliance penalties
Reputational risk: Loss of trust
