If any such liens or claims are asserted, Affiant shall promptly cause them to be discharged or bonded as required by the Agreement or applicable law, and shall indemnify and defend Recipient against such liens, claims and related costs.

3. REPRESENTATIONS AND WARRANTIES

Affiant represents and warrants that (a) it has full authority to execute and deliver this Affidavit and to make the certifications herein; (b) all work performed was in substantial conformity with the Agreement and accepted industry standards; and (c) to the extent any warranties are required by the Agreement or by law, such warranties shall commence as of the Completion Date set forth herein.

Affiant shall indemnify, defend and hold harmless Recipient and its agents, officers and employees from and against any and all claims, losses, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of or resulting from any breach of the representations and warranties in this Affidavit or from any undisclosed liens, claims or obligations relating to the Project attributable to Affiant's performance.
