Affiant represents and warrants the following as of the date of this Affidavit and for a reasonable period thereafter: (a) Affiant is the lawful owner with authority to transfer title; (b) all information provided in this Affidavit is true, accurate, and complete to the best of Affiant's knowledge; (c) Affiant has disclosed all material facts that would affect the bull's health, breeding soundness, or marketability; and (d) Affiant has no knowledge of any disease condition that would legally prohibit interstate movement or sale under applicable animal health laws.

ANY WARRANTIES NOT EXPRESSLY STATED IN THIS AFFIDAVIT ARE DISCLAIMED, EXCEPT WHERE EXPRESSLY PROVIDED OTHERWISE IN A SEPARATE WRITTEN SALES AGREEMENT SIGNED BY AFFIANT AND RECIPIENT.

6. INDEMNIFICATION

Affiant agrees to indemnify, defend, and hold harmless Recipient, its agents, successors and assigns from and against any and all losses, claims, liabilities, costs and expenses, including reasonable attorneys' fees, arising out of any breach of the representations and warranties contained in this Affidavit or from any undisclosed lien, encumbrance or misrepresentation of material fact.

7. INSPECTION, TESTING AND ACCESS

Recipient shall have the right, at Recipient's expense and upon reasonable notice, to inspect the bull, review veterinary records, and arrange for independent testing. Any dispute as to pre-existing conditions discovered by such inspection shall be governed by the indemnity and warranty provisions of this Affidavit.

8. DELIVERY, RISK OF LOSS AND FEES

Unless otherwise agreed in writing, risk of loss or damage to the bull remains with Affiant until physical delivery to Recipient or Recipient's agent is complete. Any costs associated with transportation, quarantine, testing, or health certificates shall be paid by the party specified in the contemporaneous sales or transfer agreement.
