GENERAL INDOOR WAIVER

This General Indoor Waiver ("Waiver") is entered into as of Effective Date: by and between Facility Name: having principal address (hereinafter "Facility"), and Participant Name: Participant DOB: .

RECITALS

WHEREAS, Facility operates an indoor facility that provides access to activities, equipment, programs and instruction (collectively, "Activities") at its premises; and

WHEREAS, Participant desires to participate in the Activities and acknowledges that participation involves inherent and other risks, including the risk of serious personal injury, permanent disability and death; and

WHEREAS, Facility requires execution of this Waiver as a condition to permitting participation in the Activities.

NOW, THEREFORE, in consideration of the mutual promises and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:

Participant will engage in the following Activities at Facility during the term of this Waiver:

Participant acknowledges and understands that participation in the Activities involves risks, hazards and dangers that may result in property damage, personal injury, permanent disability or death. Participant freely and expressly assumes all risks, whether known or unknown, inherent or otherwise, arising out of or related to participation in the Activities, including but not limited to risks arising from Facility’s equipment, premises, instruction, supervision, and the acts or omissions of other participants or third parties.

3. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by law, Participant, on behalf of Participant and Participant's heirs, personal representatives, successors and assigns, hereby releases, waives, discharges and covenants not to sue Facility, its owners, directors, officers, employees, agents, volunteers, contractors and affiliates (collectively, "Released Parties") from any and all liability, claims, demands, causes of action, losses or damages, whether in contract, tort (including negligence) or otherwise, arising out of or in any way connected with Participant's participation in the Activities, including claims for personal injury, property damage, wrongful death, or economic loss.

4. INDEMNIFICATION

Participant agrees to indemnify, defend and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys' fees and court costs) arising out of or resulting from Participant's acts, omissions, negligence or willful misconduct in connection with participation in the Activities or breach of this Waiver.

5. MEDICAL TREATMENT; HEALTH REPRESENTATIONS

Participant certifies that Participant is physically fit and has no medical condition that would prevent safe participation. In the event of injury or illness, Participant authorizes Facility to obtain emergency medical treatment on Participant's behalf if Facility is unable to contact Participant (or Participant's emergency contact). Participant acknowledges and agrees to be responsible for all costs of such treatment.
